V-75-2 OF THE WILLIAMSHIRE HOMEOWNERS ASSOCIATION ~ING CO~4ISSION OF THE CITY OF TUSTIN GRANTING A VARIANCE ON APPLICATION NO. V-75-2 OF THE WILLIAMSHIRE HO~O~'~ERS ASSOCIATION The Planning Commission of the City of Tustin does hereby resolve as follows: !. The Planning Commission finds and determines as follows: a. That a proper application for variance No. V-75-2 was filed on behalf of the Williamshire Homeowners Association for a variance to waive the 50% open space requirement of the P.D. (Planned Development) District, and to permit' the installation of open trellis__ patio covers, and/or porch roofs over existing patios, for the ~'properties located at 15500-15512 Williams Street. also known as the Williamshire Condominium complex. b. That a public hearing was duly called, noticed and held on said applica.~ion. c. That.because of special circumstances' applicable to the subject property, relative to size, sha , topography, location or surroundings, a strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications, evidenced by the following findings: (1) That other properties of similar uSes are permitted patio covers of open trellis and beam constr~ction. (2) That patio covers of open trellis and beam construction do not prohibit adequate light and air from entering the properties. d.", That the granting of a variance as herein provided will not constitute a grant of special privilege inconsistent with the limitations upon other pro- perties in the vicinity and district in which the subject property is situated. e. That the granting of the variance as herein provided will not be contrary to the intent of the Zoning Ordinance or the public safety, heal and welfare, and said variance should be grante f. The proposed development shall be in accordance with the Zoning Ordinance and the development policies adopted by the City Council, Uniform Building Codes as a~Lministered by the Building Official, Fire. Code as administered by the Fire C~ief, and street improvement requirements as administered by t_he City Engineer. 1 2 $ 6 7 8 9 10 13 14 16 17 18 I9 20 21 23 25 2~ 27 28 29 30 31 32 That a request for exemption from the Enviornmental Impact Report procedures has been filed and approved. · The Planning Commission hereby grants a variance as applied for, to permit a waiver of the 50% open space requirement of the PD (Planned Development) District, and to permit the installation of open trellis patio covers, and/or porch roofs over existin¢ patios subject to the following conditions: a~ That the porch roOfs and solid roofing shall not project further than 3 feet from the adjacent structure. b. Structures shall not be enclosed other than by existing fences. Ce d. Roof lines' of structures shall not extend closer than three feet (3') laterally to the property lines nor closer than six feet o_(6') to an adjoining patio roof line. Regulations, in,~ccordance with the authority of this Resolution, subject to approval of the City Attorney, shall be incorporated in the Rules and Regulations of the Homeowners Association, and the approval of the Homeowners Association shall be indicated prior to the application for building permits. e. That the necessary building permits be obtained prior to the erection of any structures. f, That the conditions of Resolution No. 74-25 approving Tract No. 6380 be complied with, to include the completion of street improvements and on-site paving rehabilitation, to the. satisfaction of the City Engineer.
