UP 75-16 OF HENRY HO ~4~iSSION OF THE CITY OF TUSTIN GRANTING A USE PEPa~IT ON APPLICATION NO. UP 75-16 OF HENRY HO The Planning Commission of the Ci~_; of Tusti~ does hereby resolve as follows: 8 I0 /.1. :t.8 :1.5 :i.6 :[8 :i.9 £0 2,8 8]. 1. The Planning Commission finds and determines as follows: a) -That a proper application No. U.P. 75-16 was filed on behalf of Henry Ho by Hippe & Randell, architects~ for a Use Permit to authorize a fast- food drive-in restaurant in a previously con- ~ structed but never completed structure'for the property located at 14551 Newport Avenue, southerly of Walnut Avenue. ._ b) That a public hearing was duly called; noticed and held on said application. c) That establishment, maintenance and operation of the use applied for will not,. under the circum- stances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1) That subject use is in conformance to the Tustin General Plan as adopted by the City Council of Tustin; and 2) That the development will be constructed in accordance with an approved plan for the building and site. d) That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. e) Proposed development shall be in accordance the Zoning Ordinance and ~he development policies adopted by the City Council, Uniform Building Codes as administered by t2qe Building Official, Fire Code as administered by the Fire Chief, and street improvement requirements as administered by the City Engineer. f) That a request for exemption from the Environmental Impact Report .procedures has been filed and approved. --. 2. The Planning Commission hereby grants a Use Permi+/, as applied for, to authorize a fast-food drive-in restaurant to be located within a previously con-- structed but never completed structure subject to the following conditions: ' 1 2 4 8 14 15 18 20 28 2.5 ~.? 82 a) That a complete analysis of the existing structure shall be submitted by either an architect or engineer incorporating any changes in the structure which are contemplated in addition to a plan showing utilization of areas. b) That a kitchen equipment plan be submitted, ar:., approval by the Health Department obtained. c) That electrical plans be resubmitted by an electrical engineer showing compliance with current codes ~d undergrounding ordinance. d) That plans showing the method of accomplishing the required drainage from prOperty at rear over the drainage easement be submitted for review and approval. e) That necessary permits be obtained for all construction, and all work be accomplished in conformance witia current codes. '- f) That payment be made of the building construction tax in compliance with Ord. No. 559. g) That the development of the subject property shall be done in conforma~lce with all applicable codes and standards, to include the City of Tustin Development Standards (Resolution 73-23) , the Zoning Ordinance (Ord. 157), and the Sign O~dinance (Ord. 614). h) That final development plans to include plot, elevations, materials, landscaping, irrigation, lighting, and signing, be submitted for review and approval by staff. i) Installation of street trees per the City of TustJ Master Plan for street trees. j) Installation of all utilities underground with no additional overhead poles to be set within the property or adjacent to street right, of-way. k) Installation of street improvements to the approval of the City Engineer and County of O~a.nge Road Dept. 1) That said use shall be conducted so aS not ~o :present A nuisance to the public or adjoining property owner in regard to noise, litter, and public health (o~ors, etc.) PASSED AND ADOPTED at a regular meeting of the Planning Commission, held on the 14th day of July, 1975.
