A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN GRANTING A USE PERMIT ON APPLICATION NO. 75-13,
OF SAN MAR MANAGEMENT CO.

Tine Planning Commission of the City of Tustin does here]~
resolve as follows:
1. The Planning Commission finds and determines as
follows:
a)
That a proper application No. UP 75-13 was filed
on behalf of San Mar Management Co. for a Use
Permit to authorize the development and operation
of a baseball batting range and tennis practice
alley for the property located on the south side
of Laguna Road, between Newport Avenue and Orange
St., more particularly described as a portion of
Loto~ 33 in Block 11 in the Irvine ~Subdivision.
b) That a public hearing was duly called, noticed
and held on said application.
c)
That establishment, maintenance and operation of
the use applied for will not, under the circum-
stances of -~uhis case, be detrimental to the health
safety, morals, comfort or general welfare of the
persons residing or working in the neighborhood
·
of such proposed use, evidenced by the followin
findings:
1)
That said development is in conformance to
the Tustin General Plan.
2)
That the subject development will be in con-
formance with the development standards of the
City of Tustin.
d)
3)
That subject use will provide a commercial
recreational facility for public use.
That the establishment, maintenance ~nd Operation
of the use applied for will not be injurious or
detrimental to the property and improvements in
the neighborhood of the subject property, nor to
the general welfare of the City of Tustin, and
should be granted.
e)
Proposed development shall be in accordance with
the Zoning Ordinance and the development policies
adopted by the City Council, Uniform Building
Codes as administered by the Building Official,
Fire Code as administered by the Fire Chief, an
street improvement requirements as administered
by the City Engineer.
f)
That a request for exemption from the Environmenta
Impact Report procedures has been filed and
approved.

The Planning Commission hereby grants a Use Permit,
as applied for, to authorize the development and
operation of a baseball batting range and tennis
practice alley subject to the following conditions:
a)
That final development plans be submitted for
staff review and approval to include plot,
elevations, landscaping, irrigation, lighting,
and signing plans.
b)
That improvement plans be submitted, and that the
following improvements be installed to the satis-
faction of the City Engineer: paving, curbs,
gutters, driveways, sidewalks, street lights
and street trees.
c)
That sanitary sewer and water facilities be
provided.
d)
That the subject parcel be annexe.d_ to the Tustin
Lighting District.
e)
That operations shall not be conducted later than
10:00 p.m.
f)
In the event the operations are vacated for a
period of 30 days, the owner or operator shall.
remove all screening and netting within 120 days
following the closure, with said condition being
voluntarily accepted by the applicant as a
condition of the Use Permit.
g)
The owner/operator shall maintain the grounds,
netting, and facilities in a state of repair,
and cleanliness.
PASSED A_ND ADOPTED at a regular meeting of the Planning
Commission, held on the 23rd day of June, 1975.
