HomeMy WebLinkAboutPC RES 1441 1 2 4 6 ? 8 9 10 11 12 13 14 15 17 19 2O 26 3O 31 RESOLUTION NO. 1441 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN RECOMMENDING THE CREATION OF THE CLASSIFICATION OF "COMMERCIAL, GENERAL" (CG) DISTRICT AND APPLYING THE CLASSIFICATION TO THE PROPERTIES ON FIRST STREET, WEST OF PROSPECT AVENUE The Planning Commission of the City of Tustin does hereby resolve as follows: 1. The Planning Commission finds and determines as follows: a) That a proper application was initiated by the Planning Commission on its own motion to establish the classification of "Commercial-, General" (CG), in lieu of other designations of commercial use. b) c) That said classification is proposed for the properties on First Street, east of Prospect, ' with properties'developed in the R-3 District to be so classified, as described by Exhibit "A", attached and a part hereof. That a public hearing was duly called, noticed and held on said proposal. d) That the properties proposed for classification in the "Commercial, General" (CG) District should be subject to a public hearing and Use Permit pursuant to the requirements for Planned Unit Development. e) That subject proposal is hereby granted a negative declaration from the requirements of an Environmental Impact Report on the basis of being a ministerial action with no impact upon the environment as a result of the proposed action. f) The proposed reclassification is in conformance with the Tustin Area General Plan. g) That the proposed zone change should be adopted for the following reasons: (1) To provide uniformity of zoning classificatioz. among the cities of Orange County. (2) To authorize uniformity of development .. standards for comparable properties. (3) To recognize the status of existing developments and to establish criteria for new and redevelopment. ~ The Planning Commission hereby recommends to the City Council the adoption of an amendment to the Zoning Ordinance (Ordinance No. 157) to create the classification of the Commercial, General (CG) District and to apply said classification to the 6 ? 8 1 2 First Street properties, subject to the furthe~ requirement of a Use Permit.
