A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN RECOMMENDING CERTIFICATION OF AN AMENDMENT TO
EIR 74-2 FOR TRACT 8490

resolve as follows:

1. The Planning Commission finds and determines as
follows:
a)
That a proper application has been filed on
behalf of the K & W Development Korporation for
an amendment to EIR 74-2 for Tract 8490, pro-
posing to construct two-story residential housi.~-~
units.

That a public hearing was duly called, noticed
held on the proposed amendment.
That mitigating measures were submitted for
Commission consideration for sound attenuation.
reduce the adverse impact of noise upon the futu~
residents of the community.
d) That subject tract will be adversely impacted by
the noise and fumes from the adjoining freeway,
and that the outside living environment is not
conducive to a healthy living environment.
e) That said tract has been approved by the City ·
Council and tlnat the proposed amendment relates
only to the impact of the two-story dwelling unit:~
f) That the proposed two-story units would adversely
impact the environment from the perspective of
the line of sight from the freeway exposure.
The Planning Commission hereby recommends to the City
Council the certification of ~n amendment to EIR 74-2
to authorize two-story single family residences in
Tract 8490, subject to the following conditions:
a) Said structures shall be sound attenuated, in
accordance with the specifications and recommenda~
tions of the acoustical engineer, as submitted in
mitigation and a part of the EIR amendment and
in conformance with the Noise Insulation Standards
as set forth in Section 1092 of the California
'~ Administrative Code, Title 25.
b)
Any subsequent additions or alterations to the
proposed dwellings for habitation shall conform
to the requirements of the noise installation
standards.
c)
The acoustical engineer shall certify to the
prospective purchasers, with copy to the City
Building Official, that said structures have
been sound attenuated to meet the interior
decibel levels of 45 dB(A), as proposed by the
applicant.

d) Two-story housing structures shall not be
constructed on lots abutting the freeway, except
for lot #26, and for such other lots as the two-
story units shall be constructed, not more than
two two-story units shall be contiguous.
PASSED AND ADOPTED at a regular meeting of the Planning
Commission, held on the 12th day of May, 1975.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN DENYING THE APPLICATION OF AMALGAMATED
RESTAURANTS, INC., THE RIGHT OF UNLAWFUL CONVERSION
OF A PROFESSIONAL OFFICE BUILDING TO RESTAURANT USE
The Planning Commission of the City of Tustin does hereby
resolve as follows:
1. The Planning Commission finds and determines:
a)
That a professional office building with
authorized liquor store and catering service was
authorized by the City of Tustin on October 21,
1969 for the property known as the Heritage Hous~.
located at~ 151 N. Tustin Avenue.
b)
That said building site accommodates 29 parking
spaces, four of which are located in the front
of the structure as parallel parking spaces,
not conducive to convenience parking.

That by convenience, the parking spaces of the
adjoining property owners are used by the
customers of the Heritage House, thereby creating
a nuisance and hardship upon the adjoining
property owners.
That said property was converted .to restaurant
operations without the sanction of the City or
benefit of necessary permits for structural
alterations.
The Planning Commission hereby denies authorization
for the establishment and maintenance of restaurant
operations in a building without facilities for the
handicapped and without adequate parking design, and
hereby reaffirms its order to cease and desist the
unlawful operations.
PASSED AND ADOPTED at a regular meeting of the Planning
