U.P. 75-10, of THE DON KOLL COMPANY The Planning Commission of the City of Tustin dOes hereby resolve as follows: 1. The Planning Commission finds and determines as follows: a) That a proper application No. U.P. 75-10 was filed on behalf of the Don Koll Company for a Use Permit to allow the development of private storage units, with authorization for an on-site manager, on a portion of a Master Planned business complex for the property located at the southeast corner of Red Hill Avenue and Moulton Parkway, at the most southeasterly portion of the development. b) That a public hearing was duly called, noticed and held on said application; c) That establishment, maintenance and operation of the use applied for will not, under the circum- stances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1) That said development is in conformance to the Tustin General Plan. 2) That perimeter landscaping is to be provided around the exterior of the complex, With median planter islands in the interior drive aisles. d) 3) That said development will be compatible with the total Master Planned complex within which the development is located. That the establishment, maintenance and operation of the use .applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. e) Proposed development shall be in accordance with the zoning Ordinance and the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Fibre street i~DrovemCnt requirements as administered b_v the Cl%v Engineer .... - f) That a request ~or exemption ~rom the Environmental Impact Report procedures has been filed and approved. 1 2 4 6 ? 8 9 10 1.l 13 14 15 ~6 17 18 19 2O 21 23 26 3O 31 32 · The Planning Commission hereby grants a Use Permit, as applied for, to authorize the develoPment of private storage units, with authorization for an on- site manager on a portion of a Master Planned complex located on the southeasterly corner of Red Hill Avenue and Moulton Parkway, subject to the following conditions: a) That final development plans be submitted for staff review and approval to include landscape and building materials, irrigation, signing, lighting, and plot plans. b) That final development plans for the total business complex, of which the private storage complex is a part, be submitted for staff review and approval in conformance with the previously approved conceptual plans. c) d) That final plans shall meet with the approval of the City Engineer, Building Official, and Fire Chief and Fire Marshal. That the following requirements of the Fire Marshal be complied with: 1) 2) That a 15 foot wide fire lan~ with access gate be provided at the northeasterly corner of the private Storage complex. That a looped fire main system with minimum 8 inch mains and 2½" x 4" fire hydrants spaced approximately every 300 feet be pro- vided in accordance with the revised plan set forth by the Fire Marshal. Additionally, said hydrants shall be protected by 4 inch posts where necessary. 3) That 1 hour fire wall separations be provided in conformance to the plans set forth by the Fire Marshal which generally require 1 hour fire wall separations for each 3,000 square feet of building area. e) That' the tenant-landlord rental agreement be amended to read as follows: Entry by Landlord: 16.01 Tenant shall permit Landlord and Landlord"s agents to include public safety ~mployees of the City of Tustin, accompanied by the manager, to enter the Leased Premises at all reasonable times for the purpose of inspecting the same...etc. f) Prior to the use and occupancy of the public storage complex, a tapered roadway shall be constructed to the satisfaction of the City Engineer, sufficient to move eastbound traffic safely from the proposed multilane improvement from Red Hill Avenue easterly to the existing single lane road easterly of the development, in the critical interest of public safety. 1 2 4 6 ? 8 9 ~0 ].1 12 ].4 15 ].6 ].8 ].9 20 21 22 23 24 25 26 27 28 29 81 PASSED AND ADOPTED at a regular meeting of the Planning Commission, held on the 14th day of April, 1975.
