CALL TO ORDER at 4:00 p.m. ROLL CALL Present: Chair Doug Davert, Vice Chair Debra Fitzsimons, Secretary Jerry Amante, and Board Members John Nielsen, Matt West, and Anthony Soria Absent: Board Member Chuck Puckett Successor Agency Clerk: Patricia Estrella Others Present: David E. Kendig, Legal Counsel to the Successor Agency PLEDGE OF ALLEGIANCE — Secretary Amante PUBLIC INPUT — None CONSENT CALENDAR — It was moved by Secretary Amante and seconded by Board Member Nielsen to pull consent item 3 and to approve the balance of the consent calendar items as recommended by staff. Motion carried 6 -0 1. APPROVAL OF MINUTES — SPECIAL MEETING OF THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY OF THE FORMER TUSTIN COMMUNITY REDEVELOPMENT AGENCY HELD ON MARCH 13, 2012 Recommendation: That the Board approve the Minutes of the Special Meeting of the Oversight Board of the Successor Agency of the Former Tustin Community Redevelopment Agency held on March 13, 2012. 2. FIRST AMENDMENT TO REGULATORY AGREEMENT AND DECLARATION OF RESTRICTIVE COVENANTS FOR THE TUSTIN LEGACY COVENTRY COURT PROJECT Oversight Board of the Successor Agency of the Page 1 Former Tustin Community Redevelopment Agency Regular Meeting Minutes Recommendation /Proposed Action: Authorize the Successor Agency to the Tustin Community Redevelopment Agency ( "Successor Agency ") to enter into the First Amendment to the Regulatory Agreement for the Tustin Coventry Court Project with Tustin Coventry Seniors, LLP, the City of Tustin and Tustin Housing Authority at Tustin Legacy (within the former MCAS Tustin Redevelopment Project Area). 3. AFFIRM THAT THE HOUSING REIMBURSEMENT AGREEMENT BETWEEN THE CITY OF TUSTIN AND THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY INCLUDING THE REMAINING DEBT SERVICE SCHEDULE ARE AN ENFORCEABLE OBLIGATION (AS SHOWN ON THE RECOGNIZED OBLIGATION PAYMENT SCHEDULE) Motion: It was moved by Secretary Amante and seconded by Board Member Nielsen that the Oversight Board of the Successor Agency to the Tustin Community Redevelopment Agency affirm and reinforce that the financial responsibilities identified under the June 5, 2007 Reimbursement Agreement between the City of Tustin and Tustin Community Redevelopment, including the debt service schedule for remaining obligations under the Reimbursement Agreement, as originally agreed upon, are an enforceable and recognized obligation for the Successor Agency (as shown and identified on the Recognized Obligation Payment Schedule). Motion carried 6 -0 ADJOURNED at 4:12 p.m. The next regular meeting is scheduled for Tuesday, April 10, 2012 at 4:00 p.m. in the Council Chamber, 300 Centennial Way, Tustin, California.
