U.P. 75-1 OF EXXON COMPANY The Planning Commission of the City of Tustin does hereby resolve as follows: · The Planning Commission finds and determines as follows: a) That a proper application (No. U.P. 75-1) was filed on behalf of the Exxon Company for a Use Permit to allow the conversion of an existing full-service gas station to a self-service facility with an existing free standing freeway identification sign. Subject property is on the southeast corner of Red Hill Avenue and Nisson Road, more particularly described as 14082 Red Hill Avenue. b) That a public hearing was duly called, noticed and held on said application. c) That establishment, maintenance and operation of the use applied for will not, under the circum- stances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing.or working in the neighborhood of such proposed use, evidenced by the following findings: 1) That additional ~andscaped planters will be provided which will enhance the site. 2) That existing signing will be brought into conformance with the Sign Ordinance (Ordinance #614). 3) That approval of said request will establish the subject use as a legal, conforming one. d) That the establishment, maintenance.': and :.operation of the use applied for will not be injurious or ' detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. e) f) Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Fire Chief, and street improvement requirements as administered by the City Engineer. The Planning Commission hereby grants a Use Permit, as applied for, to authorize the establishment and maintenance of a self-serve gas station with an existing freestanding freeway identification sign, subject to the following conditions: a) That final development plans be submitted for staff review and approval to include landscape, irrigation, and plot plans. b) That a sign plan, pursuant to Ordinance ~614 (The Sign Code) be approved by staff as to design and location, authorized as follows: 1) One (1) monument sign - maximum height 6', maximum sign area 32 sq. ft. 2) Supplemental "self-serve" sign not to exceed 10 square feet of sign copy area, to be located under the canopy. 3) A supplemental price sign to be integrated into either of the above two signs. c) That any outside speaker system, if installed f¢ ~I use by customers or attendants, shall be~ operated and controlled so as to Preclude the perception of sound beyond the property lines of this site, no~ ~-~-~~a~re~di~g~of~55 dB ~A~ ~ ~ d) An attendant must be on duty at all times during operating hours to supervise dispensing operations. e) That street trees shall be installed in con- formance with Ordinance ~586 (Street Tree Ordinance) . ~f) That a set of detailed plans for the underground tank dispenser modifications shall be submitted to Fire Department for review and approval, and that all work done to the site shall meet the approval of the Fire Department. g) Compliance with City Council Resoltuion ~1015 (Service Station Development Guide) to include, but not limited to, the maintenance and operation of the service station, and the sales and storage of materials and products.
