SUBJECT: ADOPT RESOLUTION NO. 12 -35 TO ACCEPT IMPROVEMENTS FOR THE
RAWLINGS RESERVOIR REPLACEMENT — PHASE I DEMOLITION PROJECT
CIP 60136 AND AUTHORIZE THE CITY ENGINEER TO FILE A NOTICE OF
COMPLETION
SUMMARY
Construction of the Rawlings Reservoir Replacement — Phase I Demolition Project CIP 60136 has
been completed to the satisfaction of the City Engineer and is now ready for City Council
acceptance.
RECOMMENDATION
It is recommended that the City Council take the following actions:
Adopt Resolution No. 12 -35 accepting the construction of the Rawlings Reservoir
Replacement — Phase I Demolition Project CIP 60136, and
2. Authorize the City Engineer to execute and file the Notice of Completion with the Orange
County Recorder's Office.
FISCAL IMPACT
The final construction cost for the Rawlings Reservoir Replacement — Phase I Demolition Project
CIP 60136 is $506,896, including authorized contract change orders in the amount of $7,110 or
1.4 %. Sufficient funds were budgeted and appropriated in the Fiscal Year 2011 -2012 Capital
Improvement Program for this work which is funded by the 2011 Water Revenue Bonds.
DISCUSSION
The Rawlings Reservoir Demolition Project included removal of the existing reservoir including its
roof, columns, beams, sidewalls, liner, asbestos containing materials and lead containing
materials. The reservoir demolition was completed in September 2011. The project included a bid
item for the maintenance of Best Management Practices (BMPs) during the rainy season for six (6)
months after the project was completed to meet Regional Water Quality Control Board
requirements. The maintenance of the site will be taken over by the contractor for the Phase II
Construction.

The Phase I Demolition Project is deemed complete to the satisfaction of the City Engineer and is
now ready for City Council acceptance.

RESOLUTION NO. 12 -35
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF
COMPLETION FOR THE RAWLINGS RESERVOIR REPLACEMENT -
PHASE I DEMOLITION PROJECT CIP NO. 60136
WHEREAS, Insight Environmental Engineering & Construction, Inc., having a
contract with the City of Tustin to construct the hereinafter described public works and
improvement; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
works and improvement should be filed and payment of the balance due said contract
authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public works and improvement is found to be complete, and the same is
hereby accepted. Said public works and improvement is more particularly described as
follows:

CIP No. 60136
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 17th day of April 2012.
