RESOLUTION NO. 1417
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN APPROVING PARCEL MAP 74-70 ON APPLICATION
OF SUNSET BUILDERS
The Planning Commission of the City of Tustin does
hereby resolve as follows:
1. The Planning Commission finds and determines as
follows:

That an application (PM 74-70) has been filed by
Sunset Builders (Hall and Foreman, Engineers) on
behalf of Madison Gray for a parcel map to
create two parcels, one 50' x 200' and the other
identified as Parcel 1 containing 1.76 acres with
100 feet frontage on Newport Avenue, + 168' south~
of the centerline of First Street.
That said application is a revision of Parcel Map-~
74-70 considered by the Planning Commission and..~
denied by the City Council on June 17, 1974. '~
That the proposed parcel map is submitted to ~
establish the legal status of a building site
that was created by deed of record survey without
benefit of City of Tustin approval nor in
compliance with the process and procedure
established by the State Subdivision Map Act
nor City of Tustin Municipal Code. ~
d)
That said parcel 2 is in the C-1 District and ~
the proposed parcel map is not in conflict with'~<
the Land Use Element of the General Plan. ~

That said proposal is categorically exempt~from ~
the requirements of an Environmental Impact Report
f)
g)
That there will be no adverse impact upon the
parking accommodations of Parcel 1, whereby
69 spaces are required and 116 spaces are
provided.
That the southerly parcel, not a part of this
application will be adversely affected by the
reduction of parking accommodations available
to the site, and that the owners of the adjoining
medical complex acknowledge the adverse impact
upon their properties and by letter, do endorse
the application as submitted.
h)
That the owners of the southerly parcel, not a
part of this application offers to the City of
Tustin the dedicatiOn of necessary street right
of way for Newport Avenue.
i)
That the configuration of the parcels and
driveway locations require easements from the
adjoining property owners for vehicle access to
parcel 2.

2. The Planning Commission hereby approves Parcel Map
74-70 as submitted, subject to the following:
a) An agreement for vehicle access to Parcel 2
from and over Parcel 1 shall be submitted to
the City Attorney for his approval.
b) All utilities required to serve Parcel 2 shall
be installed underground with no additional
overhead poles or wires to be set on or over
the property or adjacent to street right of way.
c) Repair and/or replacement of all concrete side-
walks, curbs, gutters and driveways within the
public right-of-way.
d) Final approval by the City Engineer and
recordation of the map.
PASSED AND ADOPTED at a regular meeting of the Planning
Commission, held on the 9th day of December, 1974.
