ITEM # 3 AGENDA REPORTs� MEETING DATE TO: FROM: SUBJECT: APRIL 24, 2012 PLANNING COMMISSION COMMUNITY DEVELOPMENT DEPARTMENT SUMMARY OF PROJECTS RECOMMENDATION: That the Planning Commission receive and file this item. DISCUSSION: The following is a list of projects and activities since the Year in Review report provided at the January 10, 2012, Planning Commission meeting. The list focuses on the status of projects that the Planning Commission, Zoning Administrator, or staff approved-, major improvement projects-, Certificates of Appropriateness-, Code Enforcement activities-, and, other items of interest. • Toyota Auto Dealership (36 Auto Center Drive): Tustin Toyota is now occupying the former Joe's Garage building. Construction is complete and the dealership is in operation. Tustin Toyota • Hyundai Auto Dealership (16 Auto Center Drive): Hyundai has acquired the former Tustin Chevrolet dealership. Plans for tenant improvements are currently in plan check. Planning Commission Report Summary of Projects April 24, 2012 Page 2 • Wood Market (14551 Red Hill Avenue): Woori Market is occupying the former Freshia Market on Red Hill Avenue. Woori Market is a combination of Japanese and Korean groceries and food market. It is now open for business. • Granada Plaza (17291 Irvine Blvd.): Reconstruction of the burned down two-story office building at Irvine Blvd. and Yorba Street is underway. Permits have been issued. • Temporary Construction Yard (1211 Edinger Ave): The Planning Commission approved Conditional Use Permit 2011-15 to allow the use of a vacant lot as a temporary construction yard for a period of six (6) months. The project approval has been extended to May 31, 2012. The construction is associated with the Irvine Ranch Water District Wells 21 & 22 Desalter project. • 24 Hour Convenience Store (13842 Newport Ave): The Planning Commission approved Conditional Use Permit 2011-16 to establish and operate a 24-hour 7 - Eleven convenience store located at 13842 Newport Avenue. Tenant improvement plans are currently under review. • Aria International Market (2505 EI Camino Real): Aria International Market replaces the former Sears/Kmart building on Bryan Avenue and Tustin Ranch Road. The supermarket offers a variety of produce, meat, hot food, and bakery items. The business is now open. Aria Market • Groundwater Remediation (535 E. Main Street): The Zoning Administrator approved Conditional Use Permit 2011-18 to allow temporary groundwater remediation activates for a period of two (2) years. The groundwater remediation equipment installation is near completion. • Nunos Brothers Retail Building (15761 Tustin Village Way): The project involves reconstruction of a 15,000 square foot retail center to replace a former retail center that was destroyed by fire. The project is nearing completion. Planning Commission Report Summary of Projects April 24, 2012 Page 3 Nunos Brothers Retail Building • New Carwash (3017 Edinger Avenue): The addition of an express carwash to an existing 76 service station has been completed and open for business. The carwash tunnel design is modeled after the Tustin Blimp Hangars. • Old Town Mixed -Use Building (170 EI Camino Real): Conditional Use Permit 07- 014 and Design Review 07-015 were approved for the construction of a 7,650 square foot mixed use building. Construction has been completed and the building is partially occupied. Meyers Building • 195 EI Camino Real (former Riteway Cleaners): A new mixed-use (jewelry and coffee shop) proposal was considered by the Planning Commission on March 27, 2012. The project was continued to allow the applicant to redesign the building facade in keeping with Old Town Tustin architectural style. • First Street Specific Plan: Staff is working with the Planning Commission to revamp the First Street Specific Plan district regulations. The draft First Street Specific Plan and Design Guidelines documents are in progress. Planning Commission Report Summary of Projects April 24, 2012 Page 4 • Mixed-use Hotel Project (Newport Ave., Edinger Ave., and 55 Freeway): On April 10, 2012, the Planning Commission approved a request to develop a mixed use project on a property located at the southwest corner of Edinger Avenue and Newport Avenue intersection. The project includes 1) a 149 -room Residence Inn; 2) 144 -room Fairfield Inn and Suites; 3) an 8,885 square foot restaurant; 4) a 7,295 square foot retail building; and 5) a conditional use permit for a master sign program and joint use parking. This project is anticipated to break ground in June 2012. Residence Inn Fairfield Inn • Construction and Business License Fee Waivers: On July 19, 2011, the City Council approved a policy for construction and business license fees waivers. The construction and plan check fee waiver allowance reached its $400,000 limit. The business license fee waiver program has waived $248,142.00 as of April 13, 2012, which includes 4,670 business license renewals and 469 new licenses. The program will waive up to $350,000 in business license fees. • Tentative Parcel Map 2010-153 and Joint -Use Parking (13362, 13372, 13422 Newport Ave. & 1101 Bryan Ave.): On February 28, 2012, the Planning Commission approved a request to subdivide an existing three (3) medical office parcels into four (4) separate parcels and 39 units for condominium purposes. The project also includes a conditional use permit for joint -use parking. The Final Parcel Map has not yet been submitted. Planning Commission Report Summary of Projects April 24, 2012 Page 5 • Residential Design Guidelines for the Cultural Resources District: On April 3, 2012, the City Council voted to approve the updated Residential Design Guidelines for the Cultural Resources District. The updated Guidelines has updated photos and graphics, addresses adaptive reuse, clarifies types of architectural styles, and corrects outdated information. City of Tustin CULTURAL RESOURCES DISTRICT RESIDENTIAL DESIGN GUIDELINES • Parking Requirement Exception for Old Town Area: The City Council adopted an Ordinance to allow developers to pay a parking maintenance fee in -lieu of providing required on-site parking spaces in Old Town. The in -lieu fee will be $60.00 per parking space annually. The City Council adopted the fee resolution at its meeting on April 17, 2012. • Cream Pan Bakery (690 EI Camino Real): Cream Pan bakery is in the process of providing outdoor seating and re-configurating its kitchen area. Permits have been issued and construction should commence in the near future. • Archie's Ice Cream (12932 Newport Ave.): Tenant Improvements plans for Archie's Ice Cream next to Trader Joe's on Newport Avenue and Irvine Blvd are currently in plan check. The ice cream store is anticipated to open by summer. • Body Art (692 EI Camino Real): The City Council adopted an Ordinance to allow body art establishments in the City. The City has approved a business license for its first Body Art Facility located in EI Camino Plaza, called Platinum Ink. • MCAS Tustin Specific Plan Amendment and General Plan Amendment: The City Council adopted a resolution to amend the Conservation/Open Space/Recreation element of the General Plan to reflect existing and future parks and open spaces; and a specific Plan amendment that establishes that 30 percent of total allowable units within the City of Tustin can be rental, allows transfer of residential units and non-residential square footages between planning areas, Planning Commission Report Summary of Projects April 24, 2012 Page 6 eliminates a 9 -acre sports park from neighborhood E, requires the execution of a development agreement prior to or concurrent with City approval of any development project, and implements minor text amendments to the MCAS Tustin Specific Plan. Zoninq Administrator Actions • Conditional Use Permit 2011-20 (2872 EI Camino Real): On January 19, 2012, the Zoning Administrator approved a request to operate a yoga studio in an existing tenant suite in The Market Place shopping center. A building permit has been issued for this project. • Conditional Use Permit 2011-21 and Design Review 2011-09 (445 W. Main Street): On January 30, 2012, the Zoning Administrator approved a request to develop a guest house on an existing residential property. The applicant appealed the approval based on his objection to the deed restriction requirement. The Planning Commission approved the project subject to the original conditions of approval. Building plans have not yet been submitted. Tustin Legacy • Master Developer: The City Council has approved a Disposition Strategy having the City to assume a limited Master Developer role by marketing Disposition Packages (smaller development sites). RFPs for certain development sites have been released. • Columbus Square: Construction is progressing at Columbus Square community. The following are updates related to each development: Mirabella: The development of 60 attached townhomes at the Mirabella site is underway. Fourteen (14) units have been completed and are occupied. Planning Commission Report Summary of Projects April 24, 2012 Page 7 Augusta (formerly Astoria): The development of 64 detached single family homes is currently underway. Eighteen (18) units have been completed and sixteen (16) of those are occupied. Augusta Coventry Court: The Coventry Court 240 -unit senior rental housing complex project is nearing completion pending completion of the pool building and area. Coventry Court • Columbus Grove: Last remaining development of Ainsley Park (84 duplex units) is nearing completion. All units have been sold. Planning Commission Report Summary of Projects April 24, 2012 Page 8 • Fire Station 37 (Relocation): The City is continuing with the design development process for Fire Station 37 with the Design Consultant and the Orange County Fire Authority. The project is expected to begin construction in Summer 2012 and completed in Summer 2013. • The District at Tustin Legacy: Vestar Development Company together with the U.S. Army Reserves are in the process of exchanging properties to accommodate a new parking area for the District at Tustin Legacy. Planning Commission Report Summary of Projects April 24, 2012 Page 9 Code Enforcement • Graffiti: There were 1,110 incidents from January 1, 2012 thru April 4, 2012. • Water Quality: Existing Development Inspections (NPDES Inspections): The new permit cycle (five- year cycle which may be extended to seven years) began July 1, 2010. There are currently 112 commercial and 85 industrial for a total of 197 inspections to be completed. All required inspections have been completed for this fiscal year. Water Quality Management Plans (WQMPs): There are currently 84 WQMP's on file. Prior to the rainy season in October, 25 percent of the WQMP's on file must be inspected every year (21 inspections this year). • Administrative Citations: Twenty-three (23) cites were issued (7/1/11 through 4/4/12) for various violations such as water quality, unpermitted signage and unsafe housing conditions. Nine (9) of the citations issued are still open and fourteen (14) citations have been closed. Public Improvements — Public Works Department Update • Newport Avenue Extension (CIP No. 70131): The City, Southern California Regional Railway Authority, Burlington Northern and Santa Fe Railroad, and the Orange County Flood Control District completed review of the 100 percent design plans. Dokken Engineering, the City's consultant, is currently revising the plans based on these comments. • Roadway Rehabilitation & Sidewalk Repair (CIP No. 70001): The FY 2011-2012 Roadway Rehabilitation (Street Maintenance) and Sidewalk Repair projects will start construction towards the end of April to early May. Design for the FY 2012-2013 projects is scheduled to be initiated in early May. • Red Hill Avenue Rehabilitation between Valencia Avenue and Edinger Avenue (CIP No. 70212): The Construction will start towards the end of April to early May in conjunction with CIP No. 70001. • Mitchell Avenue/Utt Drive Pedestrian Enhancements (CIP No. 40073): Construction is now complete. The project was funded with State of California Safe Route to School Grant funds (SR2S). • Traffic signal installation on Prospect Avenue at Beneta Way/Amaganset Way (CIP No. 40077): Construction is now complete. The project was partially funded with State of California Safe Route to School Grant funds (SR2S) and the reimbursement has been received. Planning Commission Report Summary of Projects April 24, 2012 Page 10 • Traffic Signal Battery Backup Systems (BBS's), Phase I (CIP No. 40079) and Traffic Signal Controller Upgrades/ Replacements, Phase I (CIP No. 40080): The two projects were bid as one and construction is scheduled to begin in May 2012. The BBS project is the first of four phases, after which all City maintained traffic signals will be protected with battery backup systems. The Controller Upgrades / Replacement project is the first of three phases aimed at providing dependable traffic signal operation. • Red Hill Avenue Quiet Zone at railroad crossing (CIP No. 40069): All supplemental safety measures were installed at the at -grade railway crossing. The Notice of Establishment was filed with the Federal Railway Authority (FRA) and other affected agencies in early March 2011 and the Quiet Zone was formally implemented on March 24, 2011. City staff is working with OCTA and the railroads on enforcement. • Tustin Metrolink Parking Structure (CIP No. 10062): Construction is now complete. The grand opening event was held on October 25, 2011. The final certificate of occupancy was issued on January 19, 2012. Metrolink Station Parking Structure • Mitchell Avenue Storm Drain (CIP No. 50035): Construction is now complete. The project was funded by CDBG. • Rawlings Reservoir Replacement Project (CIP No. 60136): Phase I Demolition of the Reservoir was completed end of September 2011. The Phase 11 Construction project was awarded to Pacific Hydrotech Corporation on March 6, 2012. The contractor is scheduled to start work onsite mid April, 2012. The Phase 11 construction will be complete in approximately 18 months. • Tustin Avenue Well (CIP No. 60150): Design engineering (95 percent complete) is continuing for the Drilling of the Tustin Avenue Well at 1822 N. Tustin Avenue. Staff Planning Commission Report Summary of Projects April 24, 2012 Page 11 is working to secure the temporary construction easements required for the drilling and construction of the well. The drilling of the well (Phase I of the project) is tentatively scheduled to begin July 2012. • Warner Avenue Storm Drain: Vestar recently awarded a contract to KEC Engineering for construction of the Phase 2 Warner Avenue storm drain from west of Jamboree Road to Peters Canyon Channel. Construction will began in May 2012. • Tustin Ranch Road Phase 1: Tustin Ranch Road Phase 1 construction between Warner Avenue and Walnut Avenue is nearing completion and Phase 2 will begin this summer. Phase 2 will include the roadway construction, underground utilities, and a bridge over Edinger Avenue, the SCRRA railway tracks, and the Santa Ana - Santa Fe Channel. Completion date is spring 2013. The house is listed in the 2003 Survey as having a tract ranch architectural style and a "5D1" rating, signifying that it is a contributor to the Cultural Resources Overlay District. The proposed project includes fire damage repair, the conversion of an existing attached unpermitted studio apartment to a master bedroom and bathroom, a new laundry room/hall, the removal of an existing patio cover, the relocation of the front door, and interior and exterior remodeling. The proposed addition will be constructed to be compatible with the existing house in terms of exterior wall material, windows, and exterior color. New roof material is proposed for the entire house. In accordance with Ordinance No. 1001 which was adopted June 20, 1988, by the Tustin City Council, the Community Development Director has the authority to approve, approve with conditions, or deny Certificates of Appropriateness for improvements requiring a City building permit for property located within a Cultural Resource District. The Community Development Department finds and determines as follows: A. The proposed work conforms to the Municipal Code and any applicable design standards in that the proposed project meets zoning code requirements and would match the exterior colors and materials of the existing house. B. The proposed work is harmonious with existing surroundings in that the proposed project is a new addition that is proposed to match the existing house in terms of exterior materials and colors, and will not conflict with the architectural style of other surrounding structures. The proposed work is hereby approved, subject to the following conditions: 1. Prior to the start of any work, the applicant shall obtain a building permit and pay all applicable plan check and permit fees. 2. Any replacement or repair of any part of existing structure shall match the existing/proposed exterior materials, finish, and colors of the existing structure. 3.
