U.P. 74-9 OF MAURICE ENDERLE. The Planning Commission of the City of Tustin does hereby resolve as follows: 1. The Planning Commission finds and determines as follows~ a) That a proper application (No. U.P. 74-9) was filed. by Maurice Enderle, owner and applicant,for a Use Permit to allow the development of a commercial ano professional complex for the area bounded by 17th Street on the north, Newport Freeway to the west, Vandenberg Lane on the south, and extending _+ 800 feet easterly of Yorba Street. b) That a public he~ring was duly called, noticed and held on said application; . c) That establishment, maintenance and oPeration of ~ the use applied for will not, under the circum- stances of this case, be detrimental to the health safety, morals, comfort or general welfare of the- persons residing or working in the neighborhood ¢ such proposed use, evidenced by the following fir. ings: 1) Proposed plan is in conformance with the Tustin Area General Plan. ~ - 2) Circulation patterns and structural designs are compatible with surrounding developments. 3) The total property is an integration of land uses and parking accommodations. 4) The development of the property will need to be~ in conformance with the applicable codes and standards of the City of Tustin, the County of Orange, and the State of California. d) That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. e) Proposed development shall be in accordance with the development policies adopted by the City Conn- cil, Uniform Building Codes as administered by the 1 2 5 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 23 26 30 31 Building official, Fire Code as administered by the Fire Chief, and street improvement requirements as administered by the City Engineer. f) That an Environmental Impact Report (EIR 74-3) has been filed and certified for this project. g) Final development plans shall require the review and approval of the Community Development Depart- ment pursuant to Council policy as indicated in City Council Resolution 73-35. 2. The Planning Commission hereby approves the general de- velopment plans and grants a Use Permit, as applied for, to allow ~he development of an integrated commercial and professional com- )lex to be known as the Enderle Center, subject to the ~following-~ · ;onditions: . a) That incremental development plans be submitted each phase or increment of the complex, for review and approval. b) That landscaping and irrigation plans shall be sub- mitted for review and approval, and shall include, among other items, berming along all streets that adequately screens parking from street view. c) That full public improvements for the complex shall be installed to the approval of the City of Tustin. d) That a master sign plan indicating a low level de- sign scheme and in conformance with Ordinance 9614, shall be submitted for review and approval to the Community Development Department. e) That a master lighting plan shall be submitted fo~ review and approval, to include among other items, no lighting exceeding fifteen feet in height, with such lighting to be interiorly oriented. f) That Vandenberg Lane shall be fully improved when any development takes place, or permits issued for the main portion of the complex in the area bound- ed by Vandenberg Lane to the south, Yorba Street to · ~ the west, 17th Street to the north, and Enderle Center Drive to the east. g) That all plans shall be in conformance with the ap- plicable standards and codes of the City of Tustin. h) That Zone Change applications to the Planned Com- munity District be initiated for all properties 1 2 8 within the complex presently not so designated, so that the land use is in conformance with appropriat~ zoning, and that the zoning is in conformance to the Tustin Area General Plan as required by the' State Planning and Zoning Law. i) That the elevations of the proposed buildings be submitted for review an~ approval, and that said elevations conform to the appropriate exhibits included in EIR 74-3.
