RESOLUTION NO. 1407
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF TUSTIN, RECOMMENDING APPROVAL
OF TENTATIVE TRACT NO. 8490
The Planning Commission of the City of Tustin does
-
hereby resolve as follows:
1. The Planning Commission finds and determines:

That Tentative Tract Map No. 8490 has been filed
by Gerald Klein, K & W Development Korporation
P.O. Box 176, San Dimas, for the property located
easterly of the Newport Freeway between Fairhaven
and Santa Clara.

That said Tract was the subject of an Environmental
Impact Report which indicated adverse impacts
related to traffic circulation, community services,
and freeway noise which_may be mitigated by
design factors.
c. That said Tract is not in conflict wihh the Land.
Use Element of the General Plan.

That the applicant has submitted various altern-
atives related to the lot layout and traffic
circulation, none of which has received the en-
dorsement of the Planning Commission.

That the Community Development Department has pr
pared alternative tract designs that would mitigate.
against the adverse impacts of the proposed
development and provide development options to
the applicant.

The Planning Commission hereby recommends to the City
Council approval of Tentative Tract Map ~o. 8490
pursuant to one of the three alternatives as illus-
trated by the attached exhibits, subject to the
following conditions:

That all development shall be subject to the terms
and conditions of the development standards as
adopted by the City of Tustin and Ordinance 157
(The Zoning Ordinance), as amended.
b. Approval be obtained from the County of Orange,
and/or annexation to the City of Tustin, for any
-. and all properties required for access to the
tract through unincorporated areas.

for any required emergency access to the Tract f m
Fairhaven Avenue within the City of Orange.

Ap.Droval be obtained from the State Highway
Division of the California Department of Trans-
portation for required drainage accommodations,
landscape installation and acceptance of main-
tenance for landscaping on the western';tract
boundary on the freeway rights of way, and the
construction of berm and wall on the t~act boundar'
Mitigating measures related to noise control be
accommodated in accordance with the recomme
of the Environmental Impact Report.
Street dedications shall be provided as required
bv the Citv Engineer.
The formation of a maintenance district for the
maintenance of common landscape areas with
landscaping in public and common areas to be
installed by the developer in accordance wikh

landscape plans as approved by the City of Tustin.
That all utilities be installed 'underground in
all phases of tke development with no additiona%.'
overhead poles to be set within the property or.
adjacent to street right-of-way. -~
That full street improvements and emergency access
roads be installed to serve the tract per City
Standards and subject to the approval of the City
Engineer. ::
Annexation of the tract to the Tustin Lighting ......
District and the installation of marbelite street
lights with underground conduit to the satis-
faction of the City Engineer·
Storm drain facilities shall be installed to the
satisfaction of the City Engineer.
Provision for adequate sanitary sewer and domestic
water facilities to the satisfaction of the City
Engineer.
Provision of a 15 foot wide sanitary sewer
easement .~er Orange County Sanitation District
requlations.
Provision of fire hydrants as specified by the
Fire Chief.
That Tentative Tract Map No. 8490 shall be pre-
Dared in acceptable form and in accordance with
one of the alternatives as attached hereto prior
to submission for consideration and approval by
the City Council.
