A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, RECOMMENDING REZONING ON APPLICATION NO.
Z.C. 74-11 OF THE COVINGTON BROTHERS (DEVELOPERS)

Z.C. 74-11 OF THE COVINGTON BROTHERS (DEVELOPERS)
The Planning Commission of the City of Tustin does
hereby resolve as follows:
1. The Planning Commission finds and determines:
a)
That a proper application (No. Z.C. 74-11 has
been filed by Claude Clements (agent) On behalf
of the Covington Brothers (Developers) for a
zone change from the R-3 (2000) (Multiple Family
Residential) District to the PD (Planned
Development) District for the property located
at 1651 Mitchell Avenue, upon which is presentl~
situated:a 70 unit apartment complex known as
The Windsor Gardens.
b)
That a public hearing was duly called, noticed
and held on said application;
c)
That a zone change should be granted which
would authorize the conversion of an existing'
apartment complex to condominiums for the
following reasons:
1) The proposed zone change would be compatible
with adjoining properties.
2) The proposed zone change would be in con-
formance with the general plan of the Tustin~
area.
3) Conversion of the apartment complex to a '
condominium shall require the submission and
approval of a subdivision map and develo'
plans in accordance with Council policy con-
tained in Resolution No. 73-23 (Development ~
Standards and Guidelines), and in strict
compliance with the regulations of the PD
(Planned Development) District.
d)
That said zone change shall place the existing
development into a non-conforming status which
severely limits its potential for expansion,
alteration, and reconstruction inasmuch as the-
existing development does not meet certain
minimum code requirements of the PD (Planned
Development) District.
e)
That a Negative Environmental Impact Report has
been filed for this action.
2. The Planning Commission hereby recommends to the
Council approval of zone change application No. Z.C. 74-11 from
R-3 (2000) Multiple Family District to the P.D (Planned Deve
District, subject to the condition~that any future development
be submitted in strict compliance with the regulations of the ~
district and the development standards of the City.
