RESOLUTION NO. 1383.
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN GRANTING AN AMENDMENT TO THE PREVIOUSLY
APPROVED USE PERMIT APPLICATION UP 73-11, of MONTESSORI
SCHOOL, TUSTIN.
The Planning Commission of the City of Tustin does hereb~~'
esolve as follows:
1. The Planning Commission finds and determines as
ollows:
a. That a proper application was filed on behalf of
Montessori School of Tustin amending the pre-
viously approved Use Permit (UP 73-11). A~end-
ment authorizes the construction and establi~sh-
ment of a nursery school to accommodate ~

students on the property as 1700 block of the
south side of Nisson Road.
b. That a public hearing was duly called, noticed
and held on said Use Permit Amendment.
c. A request for a Negative Declaration EIR state-
ment has been filed.
d. That establishment, maintenance and operation of

fare of the persons residing or working in the
neighborhood of such proposed use, evidenced by
the following findings:

Tustin Area General Plan and authorized
as a permitted use within the zoning' dis~rict
2) Adequate screening and buffering shall be
provided for adjoining properties.
e. That the establishment, maintenance and o~er~tion

of the use applied for will not be injurious
or detrimental to the property and improvements
in the neighborhood of the subject proDer%y? nor
to the general welfare of the City of Tustin, and
should be granted.
f. Proposed development shall be in accordance with
the development policies adopted by the Ci. tv
Council Uniform Building Codes as adminis~.e:t:ed
by the Fire Chief, and street im~:~rovement r::::
quirements as administered by the "Ci'hv .~%]ngineer,
and in conformance wi. th the cri-heria
of Tustin Development GuJ.delines.

2. The Planning Commission hereby grants an amendment to
Use Permit 73-11, to allow the construction and use of a private
nursery school to accommodate 120 students, subject to the follow-
ing conditions and stipulations:
a. That all terms and conditions of the previously
approved Use Permit 73-11, as contained in
Resolution No. 1348, be complied with.
b. That the conceptual architectural style of the
structure is approved with .the wood fascia to
be included on all four sides of the building-
c. That a 6'8" decorative masonry block wall be
installed on the southeasterly property line, and
a wrought iron fence using decorative masonry
pilasters be installed on the northeasterly pro-
perty line and adjacent to the parking lot.
d. That this development be constructed in compliance
with the requirements of the Tustin Fire Department
and California State Department of Health.
e. That security devices be constructed and installed
in compliance with the requirements of the Chief
of Police, to include locks, lighting, and internal
security.
f. That underground cable TV conduit be installed
in accordance with the criteria of Ordinance No. 594.
g. That final development plans, including the rec-
ommendations for revision as stipulated by the
Planning Commission, be submitted to the Community
Development Department for approval, in accordance
with City Council Resolution 73-35, to include
plot, elevations, landscaping, materials and colors,
irrigation, lighting and signing plans.
PASSED AND ADOPTED at a regular meeting of the Planning
Conm]ission held on the 10th day of December, 1973.
