HomeMy WebLinkAboutPC RES 1382 1 2 $ 4 6 ? 8 9 10 1,1 12 13 14 15 17 18 19 2O 21 22 23 24 25 26 27 RESOLUTION NO. 1382 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, RECOMMENDING APPROVAL OF ZONE CHANGE 73-6 ON JOINT APPLICATION OF THE CITY OF TUSTIN AND THE IRVINE COMPANY. The Planning Commission of the City of Tustin does hereby resolve as follows: 1. The Planning Commission finds and determines: a) That a proper application (No. ZC 73-6) has been jointly filed by the Irvine Company and the City of Tustin Planning Commission by Resolution No. 1353 for a zone change from the Planned Community (Residential) to the Planned Community (Industrial) for the property bounded by the Santa Ana Freeway, Myford Road, Santa Fe Railroad, and proposed Jamboree Road. b) That public hearings were duly called, noticed and held on said application; c) That the zone change should be granted for the following reasons: 1) The change in zone and subsequent development would bring this parcel into conformance with the Land Use Element of the General Plan. 2) That specific land use criteria is contained within the content of the text of the dis- trict regulations, subject to review and approval of the City of Tustin. 3) The proposed land use will be of economic benefit to the community by providing employment opportunities and financial resources. 4) Conditions and restrictions have been imposed to eliminate or mitigate against adverse impact .]pon the quality of the residential community. 5) The proposed land use is compatible with the USMC Helicopter Station to the south, rail- road mainline, freeway and major arterials abutting the area. d) The proposed development shall be in accordance with: the text of the Planned Community District Regulation; development policies adopted by City Council., Uniform Building Codes as adminis- tered by the Fire Chief, Security Systems as deemed necessary by the Chief of Police for the protection of .... ~-t" -'--d ~ ~ '~"~ ~ ...... 1 2 3 4 5 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 28 31 82 and administered by the City Engineer. e) The proposed use of the property is in conformance with the Land Use Element of the General Plan and any and all plans in conflict are herewith amended in accordance with the precise designations as indicated by the text and diagrams of the Planl~ed Community (Industrial) Regulations, referenced hereby and a part' hereof of this Resolution, as though set forth in full herein. f) A draft Environmental Impact Report has been filed and reviewed for subject property and has been recommended to the City Council for acceptance and adoption by the City. 2. The Planning Commission hereby recommends to the City Council the approval of the Zone Change Application No. ZC 73-6 from Planned Community (Residential) t6 the Planned Con~munity (Industrial) District, subject to the following: a) Development criteria, processes and uses shall be in accord with the Planned Community District Regulations, as amended, to include the diagrams, representations, and commitments as contained in the report of the Irvine Company dated December 5, "Irvine Industrial Complex, 1973, entitled, . Tustin Con~m. 3~nity Plano" b) The following additional conditions and criteria are hereby stipulated: 1) Walnut Avenue shall be posted at Red Hill Avenue and Browning Avenue to read as fcl!e%~s: Commercial Vehicles Over 6,000 lbs. Gross PROHIBITED 2) No building permits shall be issued for-the area northerly of Walnut Avenue until the following street improvements have been made by the property owner, as shown on il!ustz-ation "A" of the EIR Addendum. a. The construction of the Myford !~'~herchanffe access road to the industr%al con~7?iex! with four lane access from off-ramp ra~dius. b. The construction of Walnut from the pro- posed Jamboree to interconnect with My ford Avenue. c. Tohe construction of ~'~'[yford Avenue be~we<.~n "D" S~reet and. Walnut Avenue. /// /II 3) No building permits shall be issued for the area southerly of Walnut Avenue, with the exception of the parcel designated for neighborhood commercial, until the following improvements have been made by the property owner: a. Jamboree is constructed south of Walnut to interconnect with the Moulton Parkway. b. Myford is constructed south of Walnut to interconnect with the Moulton Parkway. c. The construction of flood control facil- ities to the satisfaction of the City Engineer to mitigate against the adverse impact of an intermediate regional flood. 4) The Jamboree interchange with the Santa Ana Freeway be constructed, prior to the elimina- tion of the present Myford Freeway interchange. 5) That new building permits shall not be issued when traffic counts reach ninety (90%) percent of the projection shown on illustration "A" of the EIR addendum, until the Jamboree inter- change is constructed at the Santa Ana Freeway. 6) The hours of rail switching operations for rail service to the industrial comp.lex be restricted 7) Any on-site noise generation within the complex be limited to 70 dBA during daytime hours and 65 dBA during nighttime hours, as measured at the perimeter of any lot within the complex. 8) Those areas designated, by the site development plan for common open space, bike trails, and/or park area shall be improved and maintained either by the Irvine Industrial Complex or by a Park Improvement District, at no expense to the City of Tustino 9) Such other terms and conditions as may be deter- mined necessary by the City Council to mitigate against adverse impact of the project as re- lated to the public safety and welfare. 10. Access to the proposed Industrial Complex shall not be provided, from proposed Jamboree Road, except at the intersection at Walnut Avenue. 11.
