U.P. 73-19, OF GARY E. JOHNSON The Planning Commission of the City of Tustin does hereby resolve as follows: 1. The Planning Commission finds and determines as follows a) That a proper application (No. U.P. 73-19) was filed by Gary E. Johnson on behalf of the Tennis Factory for a Use Permit to allow a retail tennis specialty shop and construction of a related tennis court that would permit tennis instruction in the C-1 (Retail Commercial) District of the City of Tustin on the property located on the southwest corner of Walnut and Newport Avenues. b) That a public hearing was duly called, noticed and held on said application; c) That establishment, maintenance~ and operation of the use applied for will not, ~mder the circum- stances of this case, be detrimental to the health, safety, mora].s~ c©mfort or general welfare of the persons residing or working in the neighbcrhood of such proposed use, evidenced, by the fo]lowing findings: 1) Adequate parking, landscaping, lighting, and design amenities are incorporated in the various development plans. 2) That development plans require renovation and refurbishing of an abandoned service station. d) That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. e) Proposed development shall be in accordance with the development policies adcpted b~ the City Council, Uniform Building Codes as administered by the Building O~ficia]., Fire Code as administered by the Fire Chief, and street improvement require- men%s as administered by the CJ. ty Engineer. f) The proposed use of th~ property is in conformance with the ~Tustin Area Gene'r~i Plan as adopted by the City, the Conservation and Open Space Element tberein~ ~nd that. ~ Ne~ativ~ Declaration has been filed and approve~t for hhis development, which determines that this projec'~ will have no signifi- 1 2 3 4 5 6 ? 8 9 10 11 12 13 14 15 i6 17 18 19 20 21 22 25 26 27 29 2. The Planning Commission hereby grants a Use Permit~, as applied for, to allow for a retail tennis specialty shop construction of a related tennis court that will permit tennis instruction in the C-1 (Retail Commercial) District in the City of Tustin, subject 'to the following conditions. a) That development of the site shall be in con- formance with development plans as approved by 'the Planning Commission and incorporating additional items and conditions as listed below. 1) Installation of Marbe!ite street lights' with undergro~md conduit as directed by the City Engineer. 2) Installation of street trees to conform wi hh the master tree plan. 3) Removal of all unused driveway openings and replacement with curb, gutter and sidewalks per City standards. 4) Ail tennis court lighting shall be so sbieif~ed and/or designed so as not to create a gla:cc~ problem for surrounding residences, businesses or traffic flows. 5) Installation of all utilities to be und]~:.qround. on site. 6) A masonry wall shall be constructed on south property line to be one to three lee~: in height, with the final plans to be by the Community Development DepartmeDt~ 7) That a precise lighting, landscaping, J. rrJ. g>~tion trash enclosure, and sign plan be s'~,mit-ted to the Comm~unity Development Department for review and approval ~ 8) Hours of operation of the tennis court, shall cease before 9:30 P.M. daily. 9) That final, development plans shall be a!':proved by staff in accordance with City Counci'J policy as contained in Resolution No. 73-35.
