RESOLUTION NO. 1366 .- ~ A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN GRANTING A USE PERMIT ON APPLICATION NO. UP- 73-17, OF MAURICE M. LEBANOFF. The Planning Commission of the City of Tustin does hereby resolve as follows: The Plann,[ng Commission finds and determines as follow .. a) 'That a proper application (No. UP-73-17) was filed on behalf of Maurice Lebanoff for a Use Permit to allow construction of a 47 unit, two story apartment complex within the Planned Community- Multiple Family District (PC-R-3-1750), located on the westerly side of Browning Avenue, approx- imately 250' south of Nisson Road. b) 'That a public hearing was duly called, notiCed and held'on said application; c) That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons'residing or working in the neighborhood of such proposed use, evidenced by the following findings: .' 1. Proposed plan is in conformance with the Tustin Area General Plan. 2. That this project will be constructed within the proper, district under'- the Planned ~.~'~~.,,~.~n- development standards. d) That the establishment, maintenance and opera, on of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. e) Proposed development shall be in accordance with the development policies adopted by the City Council, 'Uniform Building Codes as administered by the Building Official, Fire Code as adminis- tered by the Fire Chief, and street improvement requirements as administered by the City Engineer. f) That the Development Preview Commission has con- sidered, reviewed, and recommends approval of the various plans for this development, with additions and stipulations, and that these stipulations be incorporated in the approval of any plans. g) A Negative Environmental Impact Report has been filed on the subject property. h) Final development plans shall require the review and approval of the Community Development Depart- ment pursuant to Council policy adopted by Resolution 73-35. 2 4 $ 6 8 9 10 12 14 16 18 19 20 21 22 28 25 26 2'7 30 31 32 2. The Planning Commission 'hereby grants a Use PermTt, .. as applied for, to allow c6nstruction of a 47~.unit, two-story apartment complex within the Planned Community - Multiple Family (PC-R-3-1750) District, subject to the following conditions. a) That the site be developed according to the approved precise plans to include the rec- ommendations of the Development Preview Commission and.Community Development Department. b) That an on site fire hydrant be provided. c) That new utilities be undergrounded with no additional overhead poles. d) That the site be annexed to the Tustin Lighting District. e) That all surface drainage be directed to Browning Avenue. f) That street plans be submitted and approved by the Engineering Department. g) That landscaping, irrigation, lighting, signing plans, and exterior building materials be sub- mitted to the Community Development Department for approval. h) That additional trash facilities be added, and that the trash receptacles be screened from view. i) That a 6'8" decorative bloCk wall be provided along property lines wherever necessary, to include the northerly property line adjacent to the vacant parcel if it is not acquired, and a planting strip be added along the wall where the driveway abuts the adjacent site.
