HomeMy WebLinkAboutPC RES 1360 4 5 6 7 fol lows: 8 9 · 10 14 17 19 20 21 80 RESOLUTION NO. 1360 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN GRANTING A SIX MONTH EXTENSION OF THE TEMPORARY USE PERMIT ON APPLICATION NO. UP-71-364, OF EUGENE F.TUTT The Planning Commission of the City of Tustin does hereby resolve as follows: 1. The Planning Co-mission finds and determines as a) That a proper application (No' UP-71-364) was re-advertised on September 11, 1972, on behalf of Eugene F. Tutt for a Use Permit to permit the continued use of subject property as a landscape nursery with sales of plant materials for a six-month period, subject to further six month extensions of time, on the property descr- ibed as approximately 110 feet on the northeast side of Nisson Road, and is located approximatel 435 feet southeasterly of the centerline of Red Hill Avenue... b) The applicant is requesting a six month exten- sion as provided for in the 'finding above. c) That establishment, maintenance and operation of the use applied for will not, under the cir- cumstances of thiS case, be detrimental to the health, safety, morals, comfort or general wel- fare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: -::- 1) Subject use has been in existence for one I · and one-half years, as approved and extended by the provisions of the original Use Permit (71-364) and, 2) The operation has been operated in a manner beneficial rather than determinental to the surrounding area. d) That the establishment, maintenance and opera- tion of the use applied for will not be injur- ious or detrimental to the property and im- provements in the neighborhood of the .subject property, nor to the general welfare of the City of Tustin, and should be granted. 'e) .That said use has been authorized without tlt.e benefit of public improvements related to street and drainage, due to the insignificant traffic demand and aparce development of the surround- ing area. 1 2 3 4 5 6 ? 8 9 10 11. 12 14 15 16 17 18 19 20 21 o. 26 27 3O 31 32 f) Existing and proposed developments within the surrounding area create an increasing need for improvement of the public right of way and gener property maintenance. 2. The Planning Commission hereby grants a further ex- tension~ of the Use Permit, as requested, to permit the continued' use of subject property as a landscape nursery with sales of plant materials for an additional six-month period, extending to March 11, 1974, with the stipulation %hat upon expiration of the time period of this Use Permit, there shall be required the necess'ary street improvements, as specified by the City Engineer in the interest of public health and safety.
