T ~-:,S PP. OJECT RELATED TO THE ORANGE COUNTY FLOOD CONTROL DISTRICT The Planning Commission of the City of Tustin does hereby resolve' as follows: 1. The Planning Commission finds and determines as follows: ae be That a proper application (PZ72-135) was filed on behalf of Best Years, Inc. for a zone change to the Planned Community District for the prop- erty located approximately 315 feet on the north side of Irvine Boulevard, lying between the Southern Pacific Railroad right-of-way ~and westerly towards Holt Avenue. That the City Council did by Ordinance No. 565, On Januaty 15, 1973, approve the zone change and the proposed project was in accord with the Open Space-Recreation-Conservation Elements of the Tustin Area General Plan. Ce That Best Years, Inc. desires to obtain a per- mit from the Orange County Flood ContrOl Dis- trict for underground construction and sale of rights for surface use of Flood Control prop-. erty related to the development. 2. The Planning Commission hereby determines: ae Upon review and assessment of the facts and circumstances of the proposed project, the project will have no significant affect on the environment as related to the property within the flood control district's jurisdiction, and is .hereby exempt from the requirement for an Environmental ImpaCt Report. b. The 'undergrounding construction and sale of flood control right for surface use to Best Years, are in conformance with the-Tustin Area General Plan, c. The proposed project falls within the classi- fication of a Ministerial 'Project, as described by Section 6.3 of Resolution No. 73-24 of the City Council, and is devoid of discretionary action by the City of Tustin, at this stage of the project.
