A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN GRANTING A USE PERMIT ON APPLICA-
TION NO. UP-73-B OF BOB HALL, ON BEHALF OF
MODJESKA PROPERTIES

CITY OF TUSTIN GRANTING A USE PERMIT ON APPLICA-
TION NO.0UP-73--8, OF BOB HALL, ON BEHALF OF
MODJESKA PROPERTIES
.The Planning Commission of the ~iLy of Tustin does ber~'-v
resolve as follows:
1. The Planning Commission finds and determf.nes ::s ful-
lows:
a) Tha% a proper application (No. UP 73-8) was
on. behalf of Modjeska Properties fora a Use Pemu~i%
to allow for the construction of a private park-
ing lot on the property described as 170 Mountain
View Drive.

b) That a public hearing was duly called, noticed
and held on said application.
¢) That-establishment, maintenance and operation of
the use applied for will not, under the circum-
stances of this case, be detrimental to the
health, safety, morals, comfort or general wel-
fare of the persons residing om working in the
neighborhood of such proposed use, evidenced by -
the following findings:
1) A 6'8" fence will be erected to'adequately
separate the parking lot from adjacent prop-
erties, and adequate lighting will be pro-
vided.
d) That the establishment, maintenance and operation
' of the use applied for will ~
no:~ be injurious or
detrimental to the property and improvements i~
-the neighborhood of the subject p~opertv, nor to
the general welfare of the City of Tustin, and
should be granted.
'e) Proposed development shall be in accordance with
the development policies, adopted by tne City C,.~un?
cil, Uniform Building Codes as administered by
the Building Official, Fire Code as administered
by the Fire Chief, and street improvement reqd~
ments as administered by the City Engineer.
f) The proposed use of the property is in confo£m~nc~
with the Tustin Area General Plan, the Conserva-
tion and Open Space Element therein, and has file~
a Negative Declaration which has been approved
that determines that this project will have no
significant effect on the environment.
g)' Final development plans shall require the review
and approval of ~he Development Preview Commis3ion.
2. The Planning Commission hereby grants a Use Permit:. a~
applied for, to permit the construction and use of a private pam kin.

a) That the development of the site will be in con-
formance with the plot plan as approved by the
Planning Commission and incorporating the addi-
tional items and conditions listed beloW.
b) That an additional driveway on Mountain View
Drive be added to provide adequate ingress and,
egress, with the exact location and width to b~
determined by the Development Preview Commission
and Staff.
c) That a 6'8" board-on-board fence be erected in
place of the grapestake fence indicated on the
pians.
d) That the planter be enlarged to where the bumper
stops are indicated on the plans.
e) That the lands.caping, irrigation, lighting, and
sign plans be approved by the Development Preview
Commission.
PASSED AND ADOPTED at a regular meeting of the Planning
Commission, held on the 29th day of May, 1973
