REGULAR MEETING OF THE CITY COUNCIL CITY OF TUSTIN, CALIFORNIA NOVEMBER 17, 1997 CALL TO ORDER/PLEDGE OF ALLEGIANCE The meeting was called to order by Mayor Thomas at 7:00 p.m. at the Council Chambers, 300 Centennial Way, Tustin, California. The Pledge of Allegiance was led by Boy Scout Troop 323. INVOCATION The Invocation was given by Rev. Kay Carter, Aldersgate United Methodist Church. ROLL CALL Council Present: Jeffery M. Development Martin Pastucha, Field Services Manager Valerie Crabill, Chief Deputy City Clerk Stacy Margolin, Community Services Officer Gary Veeh, Water Services Manager Gary Magill, Recreation Superintendent Bettie Correa, Senior Personnel Analyst Approximately 5 in the audience PRESENTATION TUSTIN POLICE DEPARTMENT SANTA COP PROGRAM Councilmember Doyle presented a $2,350 check to the Tustin Police Department Santa Cop Program, proceeds from the Third Annual Casino Night fundraising event. Stacy Margolin, Community Services Officer, noted that this year's Santa Cop Program would be the tenth annual program; recipient families were referred by TAFFY, community group shelters, local apartment managers, the Boys and Girls Club, and the Tustin Unified School District; the Santa Cop Program included a holiday meal, games, and a visit from Santa Claus; the program had increased from 30 children to approximately 125 during the past ten years; and she thanked the Revere House for conducting the fundraising event and donating the proceeds to the Santa Cop Program. The Tustin Buick Pontiac Marketing Director stated that Tustin Buick Pontiac was hosting the Chamber of Commerce annual Christmas mixer this year on December 18, 1997, and noted a collection location would be available that evening for donations and/or gifts for the Santa Cop Program. Councilmember Doyle announced that Santa Cop Night would be held on December 19, 1997, and the public could deliver gifts for the Program to the Tustin Police Department, Revere House, and Tustin Buick Pontiac. PUBLIC INPUT - None PUBLIC HEARING - None CONSENT CALENDAR (ITEMS 1 THROUGH 9) Item No. 9 was removed from the Consent Calendar by Councilmember Doyle, CITY COUNCIL MINUTES Page 2, 11-17-97 and Mayor Thomas on behalf of Mayor Pro Tem Saltarelli. It was moved by Worley, seconded by Doyle, to approve the remainder of the Consent Calendar as recommended by staff. Motion carried 3-0, Saltarelli and Potts absent. 1. APPROVAL OF MINUTES - NOVEMBER 3, 1997 REGULAR MEETING Recommendation: Approve the City Council Minutes of November 3, 1997. 2. APPROVAL OF DEMANDS AND.RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $588,877.14 and ratify Payroll in the amount of $371,944.81. 380-10 360-82 3. AWARD OF CONTRACT FOR SYCAMORE AVENUE STORM DRAIN AND BLOCK WALL PROJECT BETWEEN NEWPORT AVENUE AND SR -55 FREEWAY (CIP NO. 700149 RDA) Recommendation: Award construction contract to Brongo Construction, Inc. in the amount of $317,615.28 and authorize the Mayor and City Clerk to execute the contract documents on behalf of the City as recommended by the Public Works Department/Engineering Division. 400-45 4. ACCEPTANCE OF PUBLIC IMPROVEMENTS AND RELEASE OF THE WARRANTY BOND FOR TRACT NO. 14447 (RANCHO MONTEREY APARTMENTS) Recommendation: Accept all public improvements within Tract No. 14447 and authorize the release of Warranty Bond No. 16-51-65 in the amount of $3,067.00 as recommended by the Public Works Department/Engineering Division. 600-70 5. PROGRESS REPORT ON CEDAR GROVE PARK AND HERITAGE PARK (PROJECT NOS. 400041 AND 400042) Recommendation: Receive and file subject report as recommended by Parks and Recreation services. 920-35 920-65 6. LEAVE OF ABSENCE - IDA HARRIS Recommendation: Authorize the City Manager to grant a 90 -day leave of absence to Ida Harris per Section 8, H(b) of the Rules and Regulations as recommended by Personnel Services. 520-65 7. RESOLUTION NO. 97-110 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR WATER MAIN REPLACEMENT ON FAIRHAVEN.AVENUE BETWEEN HEWES AVENUE AND ESPLANADE AVENUE AND INSTALLATION OF A NEW WATER MAIN ON ESPLANADE AVENUE BETWEEN FAIRHAVEN AVENUE AND AN EXISTING MAIN TERMINATING 1,200 FEET NORTH OF 17TH STREET, AND SANTA CLARA AVENUE WATER MAIN FROM PROSPECT AVENUE TO ESPLANADE AVENUE (CITY PROJECT NO. 600138) AND AUTHORIZING ADVERTISEMENT FOR BIDS Recommendation: Adopt Resolution No. 97-110 approving plans and specifications and authorizing advertisement for bids for subject project as recommended by the Public Works Department/Water Division. 400-45 8. AWARD OF CONTRACT FOR CONSTRUCTION OF HERITAGE PARR (CIP NO. 400042) Recommendation: Award the construction contract for Heritage Park to Valley Crest Landscape in the not -to -exceed amount of $1,414,528.96 and authorize the Mayor and City Clerk to execute the contract documents subject to City Attorney approval as recommended by Parks and Recreation Services. 920-35 CONSENT CALENDAR ITEM NO. 9 - PLANNING COMMISSION ACTION AGENDA - NOVEMBER 10, 1997 Item No. 2, Vesting Tentative Tract Map 97-117, Conditional Use Permit 97- 005 and Design Review 97-009 was appealed by Mayor Thomas on behalf of Mayor Pro Tem Saltarelli. Item No. 3, Appeal of Conditional Use Permit 97-014 and Design Review 97- 023 was appealed by Councilmember Doyle. ORDINANCE NO. 1189, CODE AMENDMENT 97-001 (CITY OF TUSTIN) It was moved by Worley, seconded by Doyle, to have second reading by title only and adoption of Ordinance No. 1189. The City Clerk read the following Ordinance No. 1189 by title only: ORDINANCE NO. 1189 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AN AMENDMENT TO TUSTIN CITY CODE SECTION 9224b, PLANNED DEVELOPMENT DISTRICT, TO IDENTIFY HOME OCCUPATIONS AS OUTRIGHT PERMITTED USES CONSISTENT WITH OTHER RESIDENTIAL ZONING DISTRICTS Motion carried 3-0, Saltarelli, Potts absent (roll call vote). 11. ORDINANCE NO. 1190, ZONE CHANGE 97-003 460-50 It was moved by Doyle seconded by Worley, to have second reading by title only and adoption of Ordinance No. 1190. The City Clerk read the following Ordinance No. 1190 by title only: ORDINANCE NO. 1190 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING ZONE CHANGE 97-003 TO AMEND SECTION 3.6.3.A OF THE EAST TUSTIN SPECIFIC PLAN TO ACCOMMODATE SIDE ENTRY GARAGE SETBACKS WITHIN THE LOW DENSITY LAND USE DESIGNATIONS WITHIN SECTORS 8, 9 AND 10 OF THE EAST TUSTIN SPECIFIC PLAN AREA ow" Motion carried 3-0, Saltarelli, Potts absent (roll call vote). 12. ORDINANCE NO. 1191, ZONE CHANGE 97-002 610-60 It was moved by Dovle seconded by Worley, to, have second reading by title only and adoption of Ordinance No. 1191. The City Clerk read the following Ordinance No. 1191 by title only: ORDINANCE NO. 1191 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING ZONE CHANGE 97-002 TO AMEND SECTION 2.0 AND EXHIBIT 1 OF THE JAMBOREE PLAZA DISTRICT REGULATIONS TO MODIFY THE PLANNING AREA BOUNDARIES WITH THE JAMBOREE PLAZA DEVELOPMENT LOCATED ON THE NORTHWEST CORNER OF EDINGER AVENUE AND JAMBOREE ROAD Motion carried 3-0, Saltarelli, Potts absent (roll call vote). 13. PROPOSED BALLOT MEASURE FOR THE NOVEMBER 1998 ELECTION 610-60 Mayor Thomas announced that Councilmember Potts hadrequested this item be continued to the December 1, 1997 Council meeting. TUSTIN COMMUNITY FOUNDATION REQUEST FOR FUNDING Mayor Thomas announced that Councilmember Potts had requested this item be continued to the December 1, 1997 Council meeting. Council concurred. 125-45 PUBLIC INPUT - None OTHER BUSINESS TUSTIN HIGH SCHOOL FOOTBALL TEAM Councilmember Doyle noted that Tustin High School's football team remained undefeated. CITY COUNCIL MINUTES Page 4, 11-17-97 "All STREET RECONSTRUCTION Councilmember Doyle commended staff and the public works contractor for excellent performance during reconstruction of his residential street. DINOSAUR DASH Councilmember Worley reported that the Dinosaur Dash had been a successful and well organized event. Mayor Thomas noted that the Dinosaur Dash was well attended and commended volunteers for their considerable time and effort. MCAF HANGER Councilmember Worley noted an ABC national news segment on economy growth featured use of the MCAF Tustin hanger by HBO film crews. PRAYER BREAKFAST Mayor Thomas reminded everyone the Mayor's Prayer Breakfast would be held on November 21, 1997, with an expected 200 attendees. COMMITTEE REPORTS - None CLOSED SESSION - None ADJOURNMENT Mayor Thomas adjourned the meeting at 7:16 p.m. The next regular meeting of the City Council was scheduled for Monday, December 1, 1997, at 7:00 p.m. in the Council Chambers at 300 Centennial Way. ell PAMELA STOKER, CITY CLERK v .
