UP-73-7 OF PUP N' TACO FAST FOOD RESTAURANT The Planning Commission of the City of Tustin does y resolve as follows: 1. The Planning Commission finds and determines as follows: 10 11 12 15 14 15 16 17 18 lg 2O 21 22 '23 24 25 26 27 a) That a proper application (UP-73-7) was filed by Pup n' Taco, Incorporated, for a Use Permit to authorize the construction and operation of a fast food restaurant and drive-up, in the C-2-P District in the City of Tustin, on the property located at the southwest corner of First Street and E1 Camino Real. b) A public hearing was duly called, noticed and held on said application; · c) That the establishment, maintenance, and oper- ation of the use applied for will noG, under the circumstances of this'case, be detrimental to the health, safety, morals, comfort or gen- eral welfare of the persons residing or work- ing in the neighborhood of such proposed use, evidenced by the following finding: 1) Adequate parking, landscaping, lighting, circulation, and design amenities are in corporated in the plot plan. The estab-~. lishment, maintenance, and operation' of use applied for, will not be injurious nor detrimental to the property and improve- ments of the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. d) Proposed development shall be in accordance with the development policies adopted by City Council, Uniform Building Code as administered by the Building Official, Fire Code as admin- istered by the Fire Chief, and street improve- ment requirements as'administered by the City Engineer. e) Said application was submitted and reviewed prior to the requirement for Environmental Impact Reports as required by the Public Re- sources Code of the State of California and the proposed development is in accord with the Tustin Area General Plan. 28 29 32 f) Final development plans shall require the r~~ view and approval of the Development Previe% Commission. / · $ 4 § 6 ? 8 9 10 11 lZ 14 15 16 18 19 20 · 25 2. The Planning Commission hereby grants a Use Permit, as applied for, to permit the construction and operation of a fast food restaurant and drive-up, in the C-2-P (Commercial) District subject to the following: a) That development of the site will be in con- , formance with the plot plan and building eleva- · tions as approved by the Planning Commission and ~ incorporating additional items and conditions as. listed below. b) The abandoned gas station shall be removed to the satisfaction of the City of Tustin, and erected in' its place, the Pup n' Taco Restaurant. c) Closure of the existing most easterly driveway on First Street, per City of Tustin Improvement Standards and to the satisfaction of the City Engine e r. d) Closure of the eXisting most northerly driveway on E1 Camino, per City of Tustin Improvement Standards and to the satisfaction of the City Engineer. e) A precise landscaping and lighting plan shall be submitted to the Development Preview Commission for their approval to include a landscaped planter around the perimeter of the site. f) Installation of landscaping to consist of potted plants adjacent to the westerly side of the building; the size of such planting to be deter- mined by the Development Preview Commission. g) Signing of the site shall consist solely of a groundbased monument sign, and no part of the sign shall exceed 4' in height and 8' in length. h) A six foot, 8 inch high decorative masonry block wall shall be installed at the westerly and southerly property lines. i) The trash encloser shall consist of the same materials as the perimeter wall. j) Any outside speaker system, for use by vehicles purchasing take-out food, shall be operated and controlled so as to preclude the perception of sound beyond the property lines of this site. // // // // -2- 8 10 11 12 15 14 15 16 17 18 20 21 ',25 24 25 26 27 28 29 30 31 32 k) InStallation of underground electric and tele- phone service from the existing supply in preparation for future conversion to an Under- ground Utility District. 1) Hours of operation shall cease at or before 10 p.m. Sunday through Thursday, and shall cease at or before.12, p.m. on Friday or Sat- urday.
