UP-73-5, OF THE FIRST SOUTHERN BAPTIST CHURCH AND WALKER & LEE REALTY OF TUSTIN GRANTING A USE PERMIT ON APPLICATION NO. UP-73-5, OF THE FIRST SOUTHERN BAPTIST CHURCH AND WALKER & LEE REALTY The Planning Commission of the City of Tustin does hereby resolve as follows: 1. The Planning Commission finds and determies as follows: a) That a proper joint application (No. UP-73-5) was filed on behalf of The First Southern Baptist Church and Walker & Lee Realty for a Use Permit to allow a professional office building and church expansion on the property described in Exhibit "A" attached hereto and incorporated herein by this reference as ~ough set forth herein in full, located on the west side of Red Hill, from San Jua~ southerly +650'. ' b) That a public hearing was duly called, noticed and held on said application. c) That establishment, maintenance and operation of the use applied for will not, under the circum- stances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing'or working in the neighborhood of such proposed use, evidenCed by the following findings: ~- 1) Subject property is bounded by public street_, -alleys, and high school site, thereby having no adverse impact upon adjoining properties. 2) Traffic circulation patterns and parking accom- modations are provided through joint usage and limited access. 3) The Planned Community District zoning classi- fication enables review of precise development plans to assure compatibility of design'and developments. d) That the establishment, maintenance and operation of the use applied for will.not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. e) Proposed development shall be in accordance with the development policies adopted by the City Coun- cil, Uniform Building Codes as administered by Building Official, Fire Code as administered by the Fire Chief, and street improvement require- ments as administered by the City Engineer. f) Proposed development is in conformance with the General Plan of the Tustin Area, including the Conservation Element. 1 4 § 6 ? 8 9 10 11 lZ 15 14 15 16 17 18 19 20 21 22 24 25 26 27 28 29 g) Included within the case action and a part of this approval are the minutes, staff reports testi~nony of the public hearing, and precise development plans. h) Final development plans shall require the review and approval of the Development Preview Commission. 2. The Planning Commission hereby grants a Use Permit, as applied for, to allow the construction of a professional office building and church expansion in the PC(C-1)C-2) Districts, subject to the following conditions: a) Compliance with the terms and conditions of Parcel Map 72-55. b) Dedication of required street right~-of-way for Red Hill, San Juan and corner cut-off. c) Construction of necessary street improvements and street lighting. d) Installation of a fire hydrant. e) Installation of perimeter screening on rear prop- erty line. f) Submission of an agreement to the City At'torney, subject to his approval, providing for common acces~ and parking accommodations.
