RESOLUTION NO. 1315

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN RECOMMENDING TO THE CITY COUNCIL DISPOSI-
TION OF SURPLUS ROAD RIGHT-OF-WAY OF ABANDONED YORBA
STREET
·
The P'lanning Commission of the City of Tustin does hereby
resolve as follows:
1. The Planning Commission finds and determines:
a) That a proper %pplication~was filed by the Planning
Commission for the purpose of determining the needs
if any, of public right-of-way known as abandoned
Yorba, southerly of 17th Street, described in
Exhibit "A" attached hereto, and incorporated here-
in by this reference as though set forth herein in
full.
b) That a public hearing was duly called, noticed, and
held on said proposal.
c) That the subject property should be declared excess
to the City's needs and disposed of for private
development for the following reasons:
1) The State of California Public Works Department
has relinquished any title interest to ~he
property.
2) The property is not suitable nor adequate for
other public purposes, such as parks or rec-
reational needs.
3) There is no known u-se of the property for pub-
lic right-of-way.
d) That the monetary valu.e of the property is of City
interest and the total community would assume "
liabilities as a result of any development on
subject property that would increase traffic flow
and congestion on Yorba, thereby justifying the
disposition of the property for financial consid-
eration.
2. The Planning Commission, pursuant to Sections 37350
and 65402 of the Government Code, hereby recommends to~he City
Council the declaration of the subject parcel as excess to the
needs of the City and its disposition for financial Consideration
for private development.
PASSED AND ADOPTED at a regular meeting of the Planning
Commission, held on the 12th day of February, 1973,

All that certain land situated in the State of California~ County of Orange~
City of Tustin, described as follows:
That portion~ of Yorba Road as shown on a Map of the Vicente Yorba Tract recorded
in Book 2, page 14 of Miscellaneous Maps records of Orange County~ California~
lying Southerly of that certain course cited as "North 3S° 21' 47" East 387.92 feet"
in deed to the State of California recorded December ?~ 1960 in Book 55S8~
page 393 of Official Records of said Orange County.
Excepting therefrom that portion thereof lying Southerly of the following
described line:

Beginning at a point in the Southerly line of Lot I of said Vicente Yorba Tract
distant along said South line and its Westerly prolongation South 88° 07' 36" East
45.30 feet from the Westerly line of said Yorba Road~ said point being in a
non-tangent curve concave Southeasterly... having a radius of 790.00 'feet~ a
radial line of said curve passing through'-~ said point bears North 65~ 57' 10" West;
thence Southwesterly along said curve through a central angle of lO~ 32' 14"
an arc distance of 145.29 feet to said Westerly line of Yorba Road.
