HomeMy WebLinkAboutPC RES 1314RESOLUTION NO. 1314 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN FINDING CONFORMANCE OF FLOOD CONTROL DISTRICT PROPERTY ACQUISITION WITH TUSTIN AREA GENERAL PLAN 1 $ 4 5 6 ? 8 9 10 11 12 14 15 16 17 18 19 £0 21 24 25 26 28 29 50 51 WHEREAS, PRC Development Corp., owner of a parcel of land located south of Main Street between Williams and Lyon Streets in the City of Tustin, has executed a deed which will modify the location .of an existing Orange County Flood Control District access easement to a position more compatible with the owner's improvements within its property and, WHEREAS, the Orange County Flood Control District proposes to accept said deed modifying the location of said access ease- ment and, WHEREAS, the Government Code of the State of California, Section 65402, provides in part that a local agency such as the flood control district shall not acquire real property nor dis- pose of any real property, nor construct a public building or structure in any county or city, until the location, purpose and extent of such activity has been reported upon as to con- formity with the adopted general plan applicable thereto; and WHEREAS, Section 21151 of the California Public Resources Code provides in part that a local agency, such as the flood control district, shall make an environmental impact statement for any project which may have a significant effect upon the environment; and WHEREAS, the Orange County Flood Control District has deter- mined that th~ repositioning Of 'this access'easement will have no significant effect on the environment; and WHEREAS, the proposed acquisition by the flood control dis- trict has been reviewed by the City of Tustin planning commission within the context of Section 21151 of the California Public Re- sources Code and Section 65402 of the California Government Code; and WHEREAS, the City of Tustin has adopted a Conservation Ele- ment of the General Plan and proposed acquisition by the flood control district is not in conflict with the Conservation Ele- ment. NOW, THEREFORE, BE IT RESOLVED, that the Tustin planning commission does hereby find that the proposed acquisition by the flood control district is in conformance with the city's adopted general plan. PASSED AND ADOPTED at a regular meeting of the Planning Commission held on the 12th day of February, 1973.
