A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN GRANTING A USE PERMIT ON APPLICATION NO.
UP-73-1, OF VILLA VALLERTO

The Planning Commission of the City of Tustin'does hereby
resolve as follows:
' 1. T~e Planning Commission finds and determines as follows:

That a proper application (No. UP-73-1) was filed
on behalf of Villa Vallerto for a Use Permit to
allow the conversion Of a 118 unit apartment complexI
with 247 parking spaces on 8 acres located at 1192
Mitchell Avenue, on the property described in Ex-
hibit'"A" attached hereto and incorporated herein.
by this reference as though set forth herein in full

That a public hearing 'was duly called,.noticed and
held on said application.
That establishment, maintenance ~nd operation of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety,
morals, comfort or general welfare of the persons
residing or working in the neighborhood, of such pro-
posed use, evidenced by the following findings:
1) The project was originally designed and con-
structed as a condominium project. ~
2) The property is bounded on. Ho sides by multi-
family developments.
3) Ground coverage of existing structures is
limited to approximately 34% of the ground ~rea,
with amp1e open space and recreational facili-
tie~ -

That the establishment, maintenance and-operation of
the use applied for wilt not be injurious or detri-
mental to 'the property and improvements in the neigh-
borhood of the subject property, nor to the general
welfare of the City of Tustin, and should, be granted
e) The proposed condominium conversion is in accord
with the General Plan and Conservation Element there-
of, with no significant environmental impact.
2. The Planning Commission hereby grants a Use Permit, as
applied for, to allOw the conversion of a 118 unit apartment com-
plex to a condominium subject to the following conditions:

1'. SubmiSsion to the Development Preview Commission and
· approval of a total landscape plan complete with pro-
yision for maintenance.
Installation of street trees on Mitchell Avenue in
accordance with Master Street Tree Plan.
3. The approval of' a final tract map.
4. The construction of a 6" water 'main with hydrants,
satisfactory to the Fire Marshal.

5, The submission to the City Attorney for review and
approval, the terms, conditions, and agreements
for the transfer of ownership or interest in the
whole or separate parts of subject lot and provi-
sions for maintenance of common areas, as related
to the physical description of the property.
