RESOLUTION NO. 1308
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN GRANTING A USE PERMIT ON APPLI-
CATION NO.UP-72-401, OF ETHEL F. DOTY
The Planning Commission of the City of Tustin does hereby
resolve as follows:
1. The Planning Commission finds and determines:

That a proper application (No. UP-72-401) was
filed on behalf of Ethel F. Doty by W. E. TenEyck
for a Use Permit to allow the development of a
100 unit apartment complex in the PC District,
on the property described in Exhibit "A" attached!
hereto and incorporated herein by this reference
as t~ough set forth herein in full.

That a public hearing was duly called, noticed ant
held on said application;

That establishment, maintenance and operation of
the use applied for will not, under the circum-
stances of this case, be detrimental to the
health, safety, morals, Comfort or general wel-
fare of the persons residing or working in the
neighborhood of such.proposed use, evidenced by
the following findings:
1) A Master Plan of Development has been approved
for the total area by UP-72-379.

Proposed residential development is in sub-
stantial conformance with the approved master
plan.
The residential ~°rtion of the total develop-
ment is. for the purpose of buffering author-
ized commercial development.
That the establishment, maintenance and operation
of the use applied for will not be injurious or
detrimental to the property and improvements in
the neighborhood of the subject property, nor to
the general welfare of the City of Tustin, and
should be granted. --
Proposed development .shall be in accordance with
.the development policies adopted by the City Coun-
cil, Uniform Building Codes as administered by
the Building Official, Fire Code as administered
by the Fire Chief, and street improvement require-
ments as administered by the City Engineer.
The proposed development is in accord with the
Conservation-Recreation-Open Space Element of the
General Plan with environmental protection and
amenities. ..
Final development plans shall require the review
and approval of the Development Preview Commlss~O.~-

2. The Planning Commission hereby grants a Use Permit,
as applied for, to allow the development of a 100 unit apartment
complex in the PC District on an area encompassing ~5.6 'a~res.~t
a density not to exceed 17.85 units per acre, in accordance with
precise plans as appendixed hereto and a part hereof, subject-to
·
the following conditions:
a) Compliance with development standards applicable
to subject property pursuant to zoning actions,
Use Permits, reports and minutes of the Planning
Commission and City Council.

b) Recommendations of the City Engineer as follows:
1) Dedication of right-of-way for the future
street on the north side of the property shal
be subject to the approval of the Engineering
Staff as to alignment and street section to
conform with the easterly and westerly ex-
tensions-of the street and as to its adequacy
to provide the needed level of service for
the area.
2) The installation of full street improvements
on both halves of the proposed street adja-
cent to this parcel.
3) The construction of a bridging structure a, o
the flood control channel at thc easterly
limits of the prop~erty.
4) The installation of public sewers to serve
the site together with any necessary off-site
easements and sewer construct~n to connect
with existing sewer facilities.
5) Annexation of the property to the Tustin
Lighting District and the installation of
street lighting on the street fronting this
development in accordance with City standards
6) Installation of drainage facilities to drain
this site into the adjacent .flood control
channel.
7) Provide paved access to a public street by
constructing one half of the proposed street
either to Prospect Avenue or to Yorba Street
at the option of the developer, This shall
include providing any necessary additional
street right-of-way needed as well as provid-
ing a full'width entry at either Prospect ¢
Yorba for adequate vehicular safety.
