UP-72-400 OF JOJO'S RESTAURANT The Planning Commission.of the City of Tustin does hereby resolve as follows: 1. The Planning Commission finds and determines'as follo~ a) That a proper application (UP-72-400) was filed' by Jojo's Restaurants, Incorporated, for a Use Permit to authorize the construction and opera- tion of a single story, 118 seat, 4500 square foot restaurant, in the Planned Community (Com- mercial) District in the City of Tustin, on the property described in Exhibit "A" attached to and incorporated herein by this reference as though set forth herein in full. b) A public hearing was duly called, noticed and held on said application; c) That the establishment, maintenance, and opera- tion of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general wel- fare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1) The proposed use is a ~ompatible use on a major arterial roadway, buffered from adjoin- ing residential properties by private street, public street, flood control channel, and rear buffering by perimeter wall and land- scaping. 2) Adequate parking, landscaping, and design amenities are incorporated in the plot plan. The establishm, ent, maintenance, and operation of the use applied for, will not be injur- ious nor detrimental to the property and im- provements of the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. d) Proposed development shall be in accordance with the development policies adopted by City Council, Uniform Building Code as administered by the Building Official, Fire code as administered by the Fire Chief, and street improvement require- ments as administered by the City Engineer. e) Fi'nal development plans shall require the review · and approval of the Development Preview Commis- sion. f) Said proposal is in conformance with the Open Space-Recreation-Conservation Elements of the Tustin Area General Plan and will result in a trivial impact upon the environment. 1 Z 4 $ ? 8 9 10 11 15 14 15 16 17 18 19 Z0 21 27 5O 2. The Planning Commission hereby grants a Use Permit, as applied for, to permit the construction and operation of a single story, 118 seat, 4500 square foot restaurant with 53 park- lng stalls, in the Planned Community (Commercial) District subject to the following: · a) Dedication of additional ten feet of right-of-way for future widening of 17th Street in accordance of the Master Plan of Arterial Highways. · b) The furnishing of agreement satisfactory to the City Attorney for access rights from the private street known as Grovesite Drive to the develop- ment ' c) Annexation of the property of the Tustin Light- lng District, and installation of one street < light on the 17th Street frontage. d) Limitation of signing for the restaurant to be restricted to the southerly property exposure to consist of a wall or ground based sign and directional signing as approved by the Develop- ment Preview Commission.
