UP-72-399, OF DANIEL M. JONES, ET AL. The Planning Commission of the City of Tustin does hereby resolve as follows 1. The Planning Commission finds and determines as follo~- _:= a) That a proper application {No. UP-72-399) was fi=« on behalf of Daniel M. Jones, etal. for a Use Fe -. to permit a neighborhood 'shopping center with a ~`~_: supermarket, restaurant, and shops to be in subs:~- tial conformance with the previously adopted mas~_ plan of development for the area in question on ~=_: property described in Exhibit "A" attached here±c = ~_ incorporated herein by this reference as though s_ forth herein in full. b) That a public hearing was duly called, noticed aai held on said application; c) That. establishment, maintenance and operation o~ ~.._~ use applied for will not, under the circumstance= ~_ this case, be detrimental to the health, safety, morals, comfort or general welfare of the person s residing or working in the neighborhood of such _:..~_- posed use, evidenced by the following findings: 1) That the proposed plan of development f or su~_ property is in substantial conformance with Master Plan of Development approved by the P1~- ning Commission and City Council for this prc~~ - ty and•properties to the west; including suc matters as building locations, structural se.- backs from adjacent residential areas, a ded_- ~- public street to Prospect Avenue on the sout~~- perimeter, adequate parking, and required pe=~- eter and landscaping areas. d) That the establishment, maintenance and operaticr.~= the use applied for will not be injurious or dew-'=- mental to the property and improvements in the r:~=_-~ boyhood of the subject property, nor to the gene'-' welfare of the City of Tustin, and should be gra..~--=- e) Proposed development shall be in accordance with --_ development policies adopted by the City Council, Uniform Building Codes as administered by the B.',; =- ing Official, Fire Code as administered by the r i= Chief , and street improvement requirements as aca.=._-- istered by the City Engineer. F f) That said proposal is in conformance with the O~-~_ Space-Recreation-Conservation Elements of the Tus--- Area General Plan. g) Final development plans shall require the review-___:. approval of the Development Preview Commission. 2. The Planning Commission hereby grants a Use Permit,.~_ applied for, to permit a neighborhood shopping center with a ~.:- supermarket, restaurant, and shops to be in substantial confc-=-:.~:== 1 2 3 4 5 6 7 with the previously adapted master plan of development for the .~~; in question, subject to the fol.lowin conditions: ~ g ~ a) The development of this parcel is to be substant'=-'--1 in~conformanc~ with the plot plan (Exhibit E) as1~.;,._- ~ ~ ~ r .- matted with this Use Permit application, subject :- the further formulation of a precise plan of deve~==- ment as approved by Staff and the Development Pre--" Commission with said plan to incorporate: l) perimeter landscaping on all sides 2) building elevations 3) interior lighting i 4) traffic circulation and parking 8 ~ 9! l0I'i 11 12 13 14 15 16 l? 18 19 20 21 22 23 24 25 26 2? 28 29 30 31 32 ~ 5) 6) interior landscaping and design precise location of buildings with the privile~= of relocation of the restaurant building to a_~-~r f for flood control channel clearance b) Dedication of right-of-way for 17th Street and Prc=- pect Avenue in accordance with the Master Plan of Arterial Highways. c) Dedication of right-of-way for a future street on ~~ south side of the property subject to the approva= .= _ the Engineering staff as to its adequacy to provic:= the needed level of service for the area. d) Approval of the Engineering staff as to driveway 1-~- tions and sizes and traffic patterns within the s~~_~_-~ i ping center. ~ - e Install ~ ation of all street improvements on both th= perimeter and interior streets in accordance with -_-~ City standards. ~~ f) Annexation of the property to the Tustin Lighting tract and the installation of street lighting on ~_ ' perimeter and interior streets in accordance with :==- standards. -i g) Installation of underground drainage facilities in Prospect at the proposed south street to connect k= _..~ the existing drain in Prospect Avenue.
