RESOLUTION NO. 1276
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN GRANTING A VARIANCE ON APPLICATION NO.
V-72-284 OF ROGER B. ROBBINS
The Planning Commission of the City of Tust~n does hereby
resolve as follows:
1. Th~ Planning Commission finds and determines as foll¢ ;:
"a)
b)
That a proper application for variance (No. V72-~0~)
was filed on behalf of Roger B. Robbins for a vari-
ance to permit construction of a two-car garage
with less than the minimum required separation dis-
tance from the main structure; less than a minimum
required overall dimensions; and, with a potentially
obstructed access for a standard size auto.

That a public hearing was duly called, noticed and
held on said application.
c)
That because of special circum§tances applicable to
the subject property, relative to size, shape, top-
ography, location or surroundings, a strict appli-
cation of the Zoning Ordinance is found to deprive
the subject property of privileges enjoyed by other
properties in the vicinity and under identical zone
classification, evidenced'by the following findings:
1. That subject parcel was'originally recorded with
only a 50-foot wide lot width;

That the existing location of permanent struc
tures on the site.prohibits, without great an
unnecessary expense, the location elsewhere c
the proposed garage; and,
d)

That the construction and location of the gar-
age as per the revised plans (Exhibit A) will
meet the intent of the Zoning Ordinance.
That the granting of a varianc~e as herein provided
will not constitute a grant of special privilege
inconsistent with the limitations upon other prop-
erties in the vicinity and district in which the
subject property is situated.

That the granting of the variance as herein provided
will not be contrary to the intent of the Zoning
Ordinance or the public safety, 'health and welfare,
and said variance should be granted.
Proposed development shall be in acdordance with the!
,Uniform Building Codes as administered by the Build-
ing Official, and Fire Code as administered by the
Fire Chief.
2. The Planning. Commission hereby grants a variance as
applie~ for, to permit the construction of a two-car garage with an
8' separation distance between said garage and the main structure,
subject to the following condition:

a. That the proposed garage shall be constructed
and located on the site in accordance with the
approved revised plans (Exhibit A).
PASSED AND ADOPTED at a regTr meeting of the Planning
commissionf:held.on the 24th day of July, 1972.
