RESOLUTION NO. 1271
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN GRANTING A USE PERMIT ON APPLICATION NO.
UP72-387, OF WILLIAM J. DOHERTY.
The Planning Commission of the City of Tustin does hereby
resolve as follows:
f. The Planning Commission finds and determines as'
~ follows:
a) That a proper application (No. UP72r387) was file,
on behalf of William J. Dohert¥ for a Use Permit
to permit a health club in an existing shopping
center on the property described in Exhibit "A"
attached hereto and incorporated herein by this
reference as though set forth herein in full.
b) That a public hearing was duly called, noticed
and held on said application;
c) That establishment, maintenance and operation of
the use applied for will not, under the circum-
stances of this case, be detrimental to the healt]
safety, morals, comfort or general welfare of the
persons residing or working-in the neighborhood
of such proposed use, evidenced by the following
finding: ~
1) That the same type of ~cility has been opera-
ted by the applicant in two neighboring citie:
in an exemplary manner.
d) That the establishment, maintenance and opera on
of the use applied for will not be injurious
detrimental to the property and improvements in
the neighborhood.of the subject property, nor to
the-general welfare of the City of Tustin, and
should be granted.

e) Proposed development shall ~e in accordance withr
the development policies adopted by the City
Council, Uniform Building Codes as administered
by the Building Official, Fire Code as adminis-
tered by the Fire Chief, and street improvement
requirements as administered by the City Engineer.
f) Final development plans shall require the review
and approval of the Development Preview Commissior
2. The Planning Commission hereby grant~ 'a Use Permit,
applied for, to permit an health club in an existing shopping cen-
ter, subject to the following conditions:
a) Installation of a Sidewalk and one marbellite
street ligh~ with underground conduit, subjec to
the City Engineer's specifications, on the Old
Irvine Boulevard frontage; and,

b) Compliance with the requirements of the Califor-
nia Administrative Code, Title '19, for 'B'
Occupancy. ~
c) That any signing for this proposed use shall cony
form to the provisions of the Sign Ordinance
(Ordinance No. 438), since the existing free-
standing sign is non-conforming as to area and
height, and will have to be removed or physically
modified.
