RESOLUTION NO. 1267
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN GRANTING AN AMENDMENT TO USE PERMIT 69-332
ON APPLICATION OF MALO, INC. (KartoPia)

The Planning Commission of the City of Tustin does hereby
resolve as follows:
·
1. .The Planning Commission finds and determines as follows:
That a proper application was filed on behalf of
Malo, Inc. for an amendment to Use Permit 69-332
to permit various types of electronic games in
conjunction with a permitted go-cart facility.,' on
the property described in Exhibit A attached hereto
and incorporated herein by this reference as though
set forth herein in full.
b) That a public hearing was duly called, noticed and
held on said aPplication; .
c) That establishment, maintenance' and operation of
the use applied for will not, under the circumstance's
of this case, be detrimental to the health, safety,'
morals, comfort, or general welfare of the persons
residing or working in the. neighborhood of such
proposed use, evidenced by the following findings:
1) The electronic gaming machines requested by
the applicant are normally an adjunct to most
types of amusement facilities.
2) That said machines will be entirelY enclosed
within the structure.

3) That the applicants have indicated that none
of these machines are designed to permit gambl-
ing of any type.
· .
d) That the establishment, maintenance and operation of
the use applied for will not be injurious or detri-
mental to the property and improvements in the
neighborhood of the subject property, nor to the
general welfare of the City of Tustin, and should
be granted.
e) Final development plans have been'reviewed and
approved by the Development Preview Commission.
2. Th'e Planning Commission hereby grants an amendment to
Use Permit 69-332 as applied for, to permit various type~; of elec-
tronic games in conjunction with the permitted go-cart facility,
subject to the following conditions:
a) That the electronic machines in question shall be
located entirely within the structure.

b) That none of the electronic machines shall be
designed or used for. gambling purposes.
c) Operations of thi's use shall be supervised to pre-
vent the creation of a public nuisance and to pro-
hibit the violation of state laws or City Ordinances~
PASSED AND ADOPTED at a regular~eeting of the Planning
commission held on the 12th day of June, 1972.
