RESOLUTION NO. 1251
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF TUSTIN GRANTING A USE PERMIT ON
APPLICATION NO. UP-71-377 OF WESTERN MORTGAGE CORP.
The Planning Commission of the City of Tustin does
hereby resolve as follows:
1. The Planning Commission finds and determines:
a) That a proper application (NO. UP-71-377) was
filed on behalf of Western Mortgage Corp. for
a Use Permit to permit the temporary use of a
trailer for banking facilities and-other of-
fice facilities until a permanent structure
can be erected. Site is generally located at
the southeasterly intersection of 17th and
Yorba Streets, known as Lots 1 and 2 of the
Vincente Yorba Tract (The Enderle Property)
with certain exceptions, and including an
area on an alignment of some 260 ft. easterly
of Yorba north, on the southerly side of 17th
Street, for the purpose of road alignment.
b) That a public hearing was duly called, noticed
and held on said application.
c) That establishment,maintenance and operation of
the use applied for will not, under the cir-
cumstances of this case, be detrimental to th~:.
health, safety, morals, comfort or general
welfare of the persons residing or working in
the neighborhood of such proposed use, evidencc~
by the following findings:.
(1) Temporary use of such structures for the
proposed purposes, until permanent struc-
tures can be constructed, represents a
valid and reasonable request;
(2) Such uses and structures, subject to those
conditions specified elsewhere in this
Resolution will not prove to be unsightly,
unsafe or deleterious to the surrounding
area.
d) That the establishment, maintenance and opera-
tion of the use applied for will not be injuric~s
or detrimental to the property and improvements
in the neighborhood of the subject property,
nor to the general welfare of the City of
Tustin and should be granted.

e) Proposed development shall be in accordance
with the development policies adopted by the
City Council, Uniform Building Code as admin-
istered by the Building Official, Fire Code
as administered by the Fire Chief, and street
~ improvement requirements as administered by
the City Engineer.
f) Final development plans shall require the
review and approval of the Development Preview
Commission.
2. · The Planning Commission hereby grants a Use Permit
as applied for, to permit the temporary use of a trailer for
banking facilities and other office facilities until a permanent
structure can be erected, subject to the following conditions:
a) Approval is granted for a six month period wit~
the proviso that six month extensions may be
granted upon application without public hearin¢
for no longer than a total period of two years
from date of approval.
b) Access shall be limited to one (1) curb cut on
the westerly property limits of 17th Street
and bonding shall be provided to the satis-
faction of the City Engineer and City Attorney
to guarantee closure of the driveway' upon
expiration of the Use Permit.
c) Dedication of right-of-way for 17th Street in
accordance with the Master Plan of Arterial
Highways.
d) Full improvements on 17th Street including curk
and gutter, sidewalk, pavement and street trees
fronting on the bank site, perimeter landscap-
ing to ultimate design standards, and sufficient
pavement transition westerly of the entrance j
driveway to allow non-interference with throug~
traffic on 17th Street.
e) Submission and approval of grading, drainage and
structural plans to the Building Department.
f) Parking lot paving, design and site landscaping
as approved by ~he Development Preview Commissar

Commission, held on the 10th day of January, 1972.
