RESOLUTION NO. 1248
A RESOLUTION OF TIlE PLANNING COMMISSION OF THE
CITY OF TUSTIN DENYING A USE PERMIT ON APPLICA-
TION NO. UP-71-372 OF FRANARGOFIN TO ESTABLISH
A RECREATIONAL BASEBALL BATTING FACILITY.
The Planning Commission of the City of Tustin does
hereby resolve as follows:
1. The Planning Commission finds and determines:
a) That a proper application (NO. UP-71-372) was
filed on behalf of Franargofin, (a general ,
partnership) by Chester L. Hall for the purpose'
of authorizing the construction and operation
of a recreational baseball batting facility in
the C-1 District on property located on Laguna i
Road south of the intersection of Orange Streetl,
described in Exhibit "A" attached hereto and
incorporated herein by this reference as though~
set forth herein in full.
b) That a public hearing was duly called, noticed
and held on said application.
c) That no evidence was presented to indicate that
the establishment, maintenance and operation of
the use applied for will not, under the circum-
stances of this case, be detrimental to the
health, safety, and general welfare of the
~o~munity.
d) That said use is located in an area surrounded
by a high school, apartment complex and nurser,/
school, and.exposed to freeway traffic.
e) The size, character and design of the facility
is such as to require extensive installation of'
utility poles, fencing, netting, and high
intensity lightinq to a degree that would be
offensive to aesthetic standards and a potentia
safety hazard.
f) The proposed development of the site is con-
sidered too intense and extensive to accommodat
necessary parking requirements and screening
from public view.
2. The Planning Commission hereby denies Use Permit

No. UP-71-372 on the basis of the above stated findings.
PASSED AND ADOPTED at a regular meeting of the ~
Planning Commission, held on the 3th day of December 1971
