A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN GRANTING A USE PERMIT ON APPLICA-
TION N0. UP-71-368,. F SHELL OIL COMPANY
The Planning Commission of the City of Tustin does
'hereby resolve as follows:
1. The Planning Commission finds and determines:
a) That a proper application (No. UP-71-368)
was f filed on behalf of Shell Oil Company
for a Use Permit to allow remodeling of an
existing service station on the property
located approximately 108 feet on the south-
east side of Newport Avenue and approximately
150 feet on the northeast side of Bryan Avenue,
known as 13462 Newport Avenue.
b) That a public hearing was duly called, noticed,
and held on said application.
c) That establishment, maintenance and operation
of the use applied for will not, under the
circumstances of this case, be detrimental to
the health, safety, morals, comfort or general
welf are of the persons residing or working in
the neighborhood of such proposed use, evidence
by the following f findings:
1) That approval of subject Use Permit would
be of advantage to both the applicatlts ar~~ `
the City, since it would permit ultimate
remodeling of the site and a consequent
enhancement to the surrounding area; and,
2) That although the applicant had requested a
withdrawal of this request, a company repre-
sentative at this meeting indicated his
company would have no objection to approval
' of the request. f
d} That the establishment, maintenance and operatio
of the. use applied for will not be injurious or
detrimental to the property and improvements in
the neighborhood of the subject property, nor to
the general welfare of the City of Tustin, and
should be granted.

~ e) Proposed remodeling shall be in accordance
~ with the development policies adopted by the
City Council, Uniform Building Codes as adminis-
tered by .the Building Official, Fire Code as
~ administered by the Fire Chief, and street
improvernent requirements as administered by the
City Engineer.
. f) Final development plans shall require the
review and approval of the Development Preview
~ Commission.
2. The
i Planning Commission hereby grants a Use Permit,
as applied for, to allow the remodeling of an existing service
station, subject to the following conditions:
a) Dedication of the ultimate right-of -way on
Bryan Avenue (an additional seven feet) and a
standard "corner cut-off" at the intersection
of Bryan and Newport Avenues.
PASSED AND ADOPTED at a regular meeting of the Planning
Commission, held on the 8th day of November, 1971.
