UP-71-369 OF ENDERLE TH~ CITY OF TUSTIN, CALIFORNIA, GRANTING A CONDI? 'i _~kL USE PERMIT ON APPL.ICATION NO. UP-71-369 OF E~.~)~'~i£111F~. The Planning Commission of the City of Tustin, California does hereby resolve as follows: 1. The Planning Commission finds and determines: a) That an application (No. UP-71-369) was filed on behalf of Mrs. Maurice Enderle for a Condi- tional Use Permit to permit development of a 134-unit, condominium single-family, planned unit development on the property described as Lots 3 and 4 of the Vincente Yorba Tract, as shown on a map recorded in Book 2, Page 14 of Miscellaneous Maps, records of Orange County, California. b) That a public hearing was duly called, notic~ and held on said application. c) That the proposed plan would not be detrimental to adjacent properties or uses and should be granted · 2. A Conditional Use Permit is hereby granted, as appli~! for, to permit development of a 134-unit, condominium, single-family, planned unit development, one and two-s~ two and three bedroom with a density factor of 13.6 dwe ing units per acre, a parking ratio of approximately 2~../' parking spaces per dwelling unit, with no two story units located closer than 115 feet of the southerly boundary the subject property adjacent to the Enderle Gardens development, subject to the following conditions: · a) Construction shall be in accordance with the design plans as submitted and approved by the Development Preview Commission, in accordance with those conditions as specified by Ordinance No. 487, and in accordance with the general requirements of Ordinance No. 157 (The Zoning Ordinance) as amended. b) That building permits shall not be issued until ~i specific plan for a circulation system of stree~' has been submitted and approved by the City the submission to the City and approval of a culation plan with dedication of necessary rigb of-way by the owners of adjacent commercial erties included within the master plan of gener~ development submitted and a part of the application· 4 § ? 8 9 10 11 14 19 Z0 Z4 SO c) d) 'e) f) g) h) ±) j) k) 1) m) n) Approved on-site fire hydrants be provided as per Fire Department requirements. Water supply for the fire hydrants shall be pro- vided from at least two directions. Hydrants shall be supplied by a minimum 8-inch water main. Portable fire extinguishers shall be provided as per Fire Department requirements. Circular driveway access is restricted in north central portion of the development. This section of drive shall be widened to a minimum of 25 feet to provide sufficient access for fire fighting equipment. Submission and approval of a Parcel Map to reflec the division of recognized parcels, including ful street improvements of the "not a part" parcel southerly of the proposed apartment development. · Granting of additional street right-of-way for Yorba Street in accordance with the Master Plan of Arterial Highways (40 feet half right-of-way width for Yorba Street). Provide adequate street' lighting on the Yorba Street frontage and annex the property to the Tustin Lighting District. Construct full street improvements including gutter, paving and sidewalk on the adjacent half of Yorba Street to city standards as approved by the City Engineer. Provide and plant street trees in accordance the Master street Tree Plan. Provide adequate drainage facilities to serve the development and connect to the existing County storm drainage facilities at the southeas corner of the project. Provide public sewers to serve the development together with any necessary off-site sewer and easements to connect to existing Sanitation District or City of Tustin sewers. Remove or relocate those segments of existing irrigation lines which appear to conflict with the proposed street construction as necessary to permit the required street and on-site con- struction work and as required by the irrigation line owner and the City Engineer. 3 4 § 6 ? 8 9 10 11 12 .13 14 15 16 17 18 19 2O 21 22 24 25 26 27 28 29 3O 31 32 O) Construction of a northerly Perimeter wall in accordance with the design plans as submitted.
