RESOLUTION NO. 1241
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN RECOMMENDING AGAINST AN AMENDMENT
TO SECTION 11.34 OF ORDINANCE NO. 157 (THE ZONING
ORDINANCE, AS AMENDED) REQUIRING GARAGES FOR
MULTI-FAMILY DEVELOPMENTS.
She Planning Commission of the City of Tustin does
hereby resolve as follows:
1. The planning Commission finds and determines:
a) On initiation of the City Council and motion
of the Planning Commission, a public hearing
was duly called, noticed and held on a pro-
posed amendment to Section 11.34 of Ordinance
No. 157 (The Zoning Ordinance, as amended)
to require that one parking space for multi-
family units shall be in a. private garage.
b) Testimony was received at the public hearing
from representatives of the building industry,
developers and apartment house managers in
opposition to the proposed requirement.
c) Reports from the Fire and Police Departments
indicated that a garage that could be locked
to make secure and separated with fire walls
would enhance the protection of life and
property.
d) A comparative analysis and reports were re-
ceived by the Commission from cities within
Orange County and National Associations, with
the weight of evidence being in support of open
carports Vs. enclosed garages for multi-family
developments.
e) A slide presentation of developments whi6h
included both enclosed garages and open carports
indicated a preference for carports in terms
of use, aesthetics, design and quality of
development.
f) The Commission is of a consensus that carports
do have an advantage over garages as related
to convenience, use and design, and that
garages in multi-family developments have the
tendency to be used for purposes other than
vehicle parking, creating hazards to safety,
and are less subject to public scrutiny and
property management control.

potential for the undesirable aspects of
exposed carports.
2. The Planning Commission hereby recommends to the
City Council the denial of an amendment to Section 11.34 of Ordim~~
No. 157 (The Zoning Ordinance, as amended) to require garages fo~
multi-family developments, and in the absence of contrary eviden,-.·
the matter be tabled without further hearing.
