HomeMy WebLinkAboutPC RES 1237 1 2 3 4 5 6 ? 8 9 10 11 .12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 1237 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, RECOMMENDING APPROVAL OF AN AMENDMENT TO THE ZONING ORDINANCE NO. 157, AS AMENDED, RELATIVE TO THE REQUIREMENT FOR ZONE BOUNDARY WALLS. The Planning Commission of the City of Tustin does here resolve as follows: 1. The Planning Commission finds and determines: a) That after public hearing duly called, noticed and held, an amendment to Ordinance No. 353, Section 5.11 (C), Zoning Ordinance'No. 157, was initiated by Resolution of the Planning Commission; and, b) The code requirement for a zone boundary wall in certain instances causes an unnecessary physical redundancy and unnecessary economic burden upon the owner/developer; and, c) By amendment to the general provisions of the Zoning Ordinance, the intent of the boundary wall requirement can be maintained without the necessity of unnecessary duplication by authori~i staff direction upon certain specified findings. 2. The Planning Commission hereby recommends to the CoUncil approval of an amendment to the Zoning Ordinance No. 157, as amended, to read: Ordinance No. 353, Section 5.11(C), be amended by thee addition of the following statement: "Furthermore, that the Director, Community Development~ Department, shall have the authority to administra- tively waive or modify any wall requirements as speci- fied under Sections "B", (1) , (2) , or (3) , Ordinance No. 353, which amended the Zoning Ordinance No. 157, where there is a solid masonry wall(s) existing on the adjacent property(s) , upon finding that: (a) Existing wall meets or can be modified to confor?i to the intent of this section; and, ~ (b) Suitable landscaping shall be installed adjace~ to existing wall(s) to supplement and enhance the environmental buffering; and, (c) Protection is afforded the existing wall to prevent vehicle damage; and, (d) Concurrence of the adjacent property owner(s) obtained when necessary to modify an existing wall to meet the requirements of this section. 1 2 3 4 5 6 ? 8 9 '10 11 12 13 14 15 16 17 18 19 2O 21' 22' 23 24 25 26 27 28 29 30 31 32 PASSED AND ADOPTED at a regular meeting of the Planning Commission, held on the 11th day of October, 1971 ~_~day of ~~~'" 1971.
