HomeMy WebLinkAboutPC RES 1235 1 2 '3 4 5 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 3O 31 32 RESOLUTION NO. 1235 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, RECOMMENDING APPROVAL OF PREZONING ON APPLICATION PZ-71-128 (RE-ADVERTISED) OF FIRST WESTERN BANK AND TRUST COMPANY. The Planning Commission of the City of Tustin does hereby resolve as follows: 1. The Planning Commission finds and determines: a) That a proper application (PZ-71-128)(re-adv~_~ tised) has been filed on behalf of First Westeri Bank and Trust Co. for a prezone change from the County E-4 "Residential Estate" District · to the City of Tustin PC "Planned Community - Single-family Residential" District, on the property which fronts approximatel, y 160 fee~ on the east side of Prospect Avenue, appro>~~ mately 182 feet south of the center line o~ Theodora Drive, is approximately 1180 feet depth, and consists of approximately 6.7 acres of land. b) That a public hearing was duly called, noticed and held on said application. c) That a prezone change should be granted for the. following reasons: 1) That due to the size of the parcel involved the requested increased dwelling unit density from the E-4 to the PC R-1 Distric~ would not prove detrimental to the sur- rounding area; 2) That similar single-family densities exist on the opposite side of Prospect Avenue; an~ 3) The Tustin Area General Plan indicates Pros pect Avenue as being a transition divider between medium low density and medium density single-family residential developments. d) Development of subject property shall be in 'accordance with the policies adopted by the City Council, Uniform Building Codes as admini~ tered by the Building Official, Fire Code as administered by the Fire Chief, and street improvement requirements as administered by the City Engineer. e) Final development plans shall require the revie%~ and approval of the Development Preview Commission. 1 $ 4 5 6 ? 8 10 11 12 14 15 15 17 18 19 20 21 25 26 27 ~0 2. The Planning Commission hereby recommends to the City Council approval of prezone change application No. PZ-71~128 from the County E-4 (Residential Estate) District to t'he City of Tustin PC (Single-Family Residential) District, subject to the following conditions: a) Submission and approval of a Subdivision Map, which is in conformance with the minimum lot width and area requirements of the R-1 (Single- Family Residential) District for a minimum of 24 of the 29 proposed lots; b) Submission and aPproval of' precise plans of development for individual lots; c) The above precise plans to also include: the design, of the proposed bridge across the Orange County Flood Control Channel, with said design being subject to the combined final approval of the Orange County Flood Control District and the City of Tustin Development Preview Commis- sion; the architectural and landscaping treat- ment of the entrance to the subdivision; and, the design of some form of emergency vehicular access combined with some type of pedestrian walkway, to Prospect Avenue.
