HomeMy WebLinkAboutPC RES 1232 4 § ? 8 9 10 16 18 19 ~0 Z5 ~? 29 30 RESOLUTION NO. 1232 A RESOLUTION OF TIlE PLANNING COMMISSION OF THE CITY OF TUSTIN GRANTING A USE PERMIT ON APPLICATION NO~ UP-71-366, INITIATED BY THE PLANNING COMMISSION. The Planning Commission of the City of Tustin does hereby resolve as follows: 1. The Planning Con~issfon finds and determines as follows: A) That a proper application (No.'UP-71-366) was filed by initiation of the Planning Commission for a Use Permit · to establish a public neighborhood park consisting of approximately 3.9 acres, designed to accommodate a variety of uses including: two'Little LeagUe ball diamonds; a youth football field; picnic and landscaped areas; children play area; and, various types of athletic courts. , B) That a public hearing was duly called, noticed and held on said application; C) That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the ~ rsons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1) That the proposed use is essentially the same as that which has existed on subject property for several years; That this proposed use will provide a decided aesthetic and diversified amplification of the existing use; and, 3) That such a facility is direly required for the recreational needs of the citizenry of the City of Tustin. D) That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of TusCan, and should be granted. Proposed development shall be in accordance with the .develop- ment policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Fire Chief, and street improvement requirements as administered by the City Engineer. F) Final development plans shall require the review and approval of.the Development Preview Commission.and Staff. 2. The Planning Commission hereby grants a Use Permit, as applied for to establish a public neighborhood park consisting of approximately 3.9 $ 4 6 ? 8 9 10 11 14 15 16 17 18 Z0 24 Z5 '28 50 acres designed to accomodate a variety' of uses including: two ball diamonds; a youth football field; picnic and landscaped areas; childrens' play area; and, various types of athletic Courts; subject to the following condition: · . Rezoning of subject property from the R-2 and C-1 Districts to the P-I District. 3. It is hereby further determined that by the granting of a Use Permit for this site, additions and or modifications shall not require a public hearing.
