ORDINANCE NO. 271
AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA
AMENDING SECTION 5.11 OF THE ZONING ORDINANCE
OF THE CITY OF TUSTIN, ORDINANCE NO. 157,
AS AMENDED.
The City Council of the City of Tustin, California,
hereby ordains as follows:
Section 5.11 of the Zoning Ordinance of the City
of Tustin, Ordinance No. 157, as amended, is hereby
amended to read as follows:
Section 5.11
(A) Fences, hedges and walls may be~erected in
any district, subject to the following conditions:~
(1) Fences, hedges and walls shall not exceed
, six feet eight inches (6' 8") in height
on or within all rear and side property
lines on interior lot lines, and on or
to the rear oP all front yard setback
lines.
(2) No fence, hedge or wall over three (3)
feet in height shall be erected in any
front yard, or in the side yard on the
street side of either a corner lot or
--~ on a lot,. the rear line of which abuts
the side line of an adjoining lot.
.... (3) A six foot fence, hedge or wall may be
located not closer than five (5) feet
from the side property line on the street
side of any corner lot.
(4) Fences or structures exceeding six feet
eight inches (6'8") in height to enclose
tennis courts or similar areas, when such
fences enclose the rear half of a lot, may
be erected subject to the obtaining of a
Use Permit therefor.
(5) The provisions of this section shall not
apply to a fence or wall required by any
law or regulation of the State of California,
or any agency thereof for reasons of public
safety.
(B) Walls shall be constructed and maintained on
zone boundary lines, as follows:
(1) Where any C, M or PR zone abuts upon any
~'~ residential zone, there shall be constructed
a solid masonry wall, six feet eight inches
' (6'8") in height on the zone boundary line.
(2) Where any R-3 or R-4 zone abuts upon any
R-1 zone, there shall be constructed a solid
masonry wall, six feet eight inches (6'8")
in height, on the zone boundary line.
Where any M zone abuts upon any C
or PR zone, there shall be constructed
a solid masonry wall, six feet eight
inches (6'8") in height, on the zone
boundary line.
(4) Where a development is contiguous to
~ anexisting dedicated alley which
serves as access to residential
properties the aforesaid wall
requirement may be modified or waived
by the Planning Staff.
(5) The aforesaid walls shall be six feet
eight inches (6'8") in height except
that portion of equal depth from the
front yard on the abutting R Classified
property, which shall be three (3')
in height.
('6) Provided, however, that upon application
and proceedings pursuant to Sections
7.2, 7.21 ~nd 7.22 the Planning
~ Commission may Waive or modify the
requirements set forth in subsections
5.11 (B) (1) through (5).
(C) The fences, hedges and walls provided
herein shall be measured and constructed pursuant to
development standards of the Building Department.
PASSED AND ADOPTED at a regular meeting of the
City Council of the City of Tustin, California, held on
the 18th day of January, 1965.

and foregoing Ordinance Was duly and regularly introduced
and read at the regular meeting of the City Council held on
the 4th day of January, 1965~~ and was given its second
reading and duly passed and adopted at a regular meeting
held on the 18th day of Jahuary, 1965, by the following
vote:

NOES: COUNCILMEN Nonel
