RESOLUTION NO. 1230
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN GRANTING A USE PERMIT ON APPLICATION NO.
UP-71-367, of BERNARD SPENGLER.
The Planning Commission of the City of Tustin does hereby
resolve ..as follows:
1. The Planning Commission finds and determines as follows
a) That a proper application (UP-71-367) was filed on
behalf of :Bernard Spengler for a Use Permit to
permit an off-site subdivision directional sign
in a residential district on the property described
as Block 11, Tract 6481, AP #432-212-01.
b) That a public hearing was duly called, noticed and
held on said application;
That establishment, maintenance and Dperation of
the use applied for will not, under the circum-
stances of this care, be detrimental to the health,
safety, morals, comfort or general welfare of the
persons residing or working in the neighborhood of
such proposed use, evidenced by the following
findings:
(1) That a similar sign, advertising another resi-
dential development, existed at this same
site for over a year with no apparent detri-
mental effect on the surrounding area; and,
(2) That provisions of the Sign Ordinance (Ordi-
nance 'No. 438) guarantee removal of said
sign within a reasonable length of time.
d) That the establishment, maintenance and operation
of the use applied for will not be injurious or
detrimental to the property and improvements in
the neighborhood of the subject property, nor to
the general welfare of the City of Tustin, and
should be granted.
e) Proposed development shall be in accordance with
the development policies adopted by the City
Council, Uniform Building Codes as.administered
by the Fire Chief, and street improvement
requirements as administered by the City-Engineer.

2. The Planning Commission hereby grants a Use Permit,
as applied for to permit an off-site subdivision directional sign
in'a residential district, subject to the following condition:
~ a) The obtaining of a sign permit and posting of a
$100.00 bond as prescribed by the Sign Ordinance.
PASSED AND ADOPTED at a regular m~eeting of the Planning
Commission, held on the 13th day of September, 1971
