UP-71-365 OF DONALD H. BUSH. The Planning Commission of the CityI of Tustin does hereby r~solve as follows: 1. The Planning Commission finds and determines: A) That a proper application (No. UP-71-365) was filed on behalf of Donald H. Bush for a Use Permit to allow the use of an existing building for the purpose of conducting membership meetings and other allied affairs of Hillview Post 9302 of the Veterans of Foreign Wars, on the property whidh fronts approximately 50 feet on the west side of Prospect Street, approximately 180 feet south of the center line of First Street; further known as 130 South Prospect Street. B) That a public hearing was duly called, noticed and held on said application.; C) That establishment, maintenance and operatioh of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, eviden by the following findings. 1) That the majority of land uses in the im- mediate area are commercial in nature; and, 2) That this same proposed use has existed just north of subject location for several years with no detrimental effect on the surrounding area. D) That.the establishment, maintenance and opera- tion of the use applied for will not be injuriou or detrimental to the property and improvements in the neighborhood of the subject property, nos to the general welfare of the City of Tustin, and should be granted. E) Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Code as adminis- tered by the Fire Chief, and street improvement requirements as administered by the City Engine~ F) Final development plans shall require the rev ~,~, and approval of the Development Preview Commission. 4 ? 8 9 l0 14 15 18 19 21 24 2. The Planning Commission hereby grants a Use Permit as applied for, to allow the use of an existing building for the purpose of conducting membership meetings and other allied affairs of Hillview Post 9302 of the Veterans of Foreign Wars, subject to the following conditions: A. Conformance to those requirements established by the City Engineer (Exhibit "A"); the Chief Build'ing Official (Exhibit "B"); and the Fire Chief .(Exhibit "C"), to include but not limited to: (1) Installation of necessary fire hydrant. (2) Conformance with Uniform Building Code for -Proposed occupancy. (3) Granting of an easement for additional street right-of-way. B. That a lease parking agreement for a minimum of 40 parking spaces within 300 feet of subject site, approved by 'the City Attorney, be filed and recorded as a part of this petition.
