UP-71-364 OF EUGENE F. TUTT. The Planning Commission of the City of ~Tustin does hereby resolve .as follows: 1. The Planning Commission finds and determines as follows a) That a proper application (No. UP-71-364) was filed by Eugene F. Tutt for a Temporary Use Permit to allow a landscape nursery with limited r~tail sales of plant materials, on that property which fronts approximately 310 feet on the northeast side of Nisson Road and is located approximately 435 feet southeasterly of the center line of Red Hill Avenue. b) That a public hearing was duly called, noticed and held on said application; c) That establishment, maintenance and operation of the use applied for will not, under the circum- stances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: That on a temporary, interim, land use basis, the proposed use would aesthetically improve the site and the surrounding area. d) That the establishment, maintenance and operation~ of the use applied for will .not be'injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the CitY of Tustin, and should be granted. e) Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered' by the Building Official, Fire Code as administered by the Fire Chief, and street improvement require- ments as administered by the City Engineer. f) Final development Plans shall require the review and approval of the Development Preview Commission. 1 4 6 ? 8 9 10 12 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 29 30 31 32 2. The Planning Commission hereby grants a Temporary six months' Use Permit, as applied ,for, to allow a landscape· nursery with limited retail sales of plant materials, subject to the foll6wing conditions: a) That the existing site shall be cleared of all dead trees, weeds, debris, etc.; b) That an appropriate chain link fence be installed around the perimeter of the property; c) That any parking areas shall be oiled or surfaced to the satisfaction of the Building Official, and that all parking spaces and required turning radii shall be provided completely on site along the western boundary. d) That subject temporary use may be extended for an additional six months' period of time at the discretion of the Planning Commission without further public hearing, upon written request from the applicant. Any further extension of time will require an advertised public hearing with consideration being given to the requirements for permanent improvements of the property and public right-of-way with additional consideration to be given to amortization or removal of the billboards.
