RESOLUTION NO. 1226
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN AMENDING RESOLUTION NO. 1221
The Planning Commission of the City Of Tustin does
hereby ..resolve as follows:
1. The Planning Commission finds and determines as
follows:
a) That Variance (V-71-279)' was granted by the
Planning Commission on June 14, 1971,(Reso-
lution No. 1221) to permit the construction
and use of a commercial-professional building
with waiver of the required number of parking
spaces;
b) That Condition 3 - g) of Resolution No. 1221
stated:
"On-site parking provisions are to be resolved
between t~he applicant, the City Attorney, and
City Staff, to the satisfaction of all parties,
to assure that parking for this facility will
not have a detrimental effect on the immediate
residential area. If this matter cannot be
satisfactorily resolved, subject Variance is
to be returned to the Planning Commission for
reconsideration and a possible rehearing".
c) That on June 28, 1971, the Planning Commission
gave further consideration to Condition 3 - g)
as requested by the applicant;
d) That the Staff, with the concurrence of the City
Attorney, recommended Condition 3 - g) of
Resolution No. 1221 be amended to read:
"That the applicant shall provide a written
agreement, acceptable to the City Attorney,
which in effect shall state that at such time
as a parking assessment district for the First
Street.Area is officially adopted by the City,
the subject property owner and/or any subsequent
property owners shall join said parking
assessment district."
2. The .Planning Commission hereby amends Condition No.
3 - g) of Resolution No. 1'221 to read as follows:
"That the applicant shall provide a written agreement,
acceptable to the City Attorney, which in effect shall
state that at.such time as a parking assessment district
for the First Street Area is officially adopted by the
City, the subject property owner and/or any subsequent
property owners shall join said parking assessment
district."
