RESOLUTION NO. 1224
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN GRANTING A USE PERMIT ON APPLICATION
NO. UP-71-363 OF TIMOTHY L. METZGER, DVM.
The Planning commission of the City of Tustin does
hereby resolve as follows: t
1. The Planning Commission finds and determines as
follows:
a) That a proper application (No. UP-71-363) was
filed on behalf of Southern California Financial
Corporation for a Use Permit to allow construction
and use of a~veterinary medical hospital on the
property which fronts approximately 170 feet on
the northeast side of Bryan Avenue, and approxi-
mately 365 feet southeast of the center line of
Newport Avenue, Tustin, California.
b) That a publiC hearing was duly called, noticed
and held on said application.
c) That establishment, maintenance and operation of
the use applied for will not, under the circum-
stances of this case, be detrimental to the health,
safety, mora~s, comfort or general welfare of the
persons residing or working in the neighborhood of
such proposed use, evidenced by the following
findings:
(1) Subject site is far enough distant from
nearby residential properties so as not to
be deleterious to their environment; and,
(2) Safeguards are provided in the Zoning Ordinance
to insure no detrimental effects from animal
noises or odors.
d) That the establishment, maintenance and operation
of the use applied for will not be injurious or
detrimental to the property and improvements in the
neighborhood of the subject property, nor to the
general welfare of the City of Tustin, and should
be granted.
e) Proposed development shall be in accordance with
the development policies adopted by the City Council
Uniform Building Codes as administered by the
Building Official, Fire Code as administered by
the Fire Chief, and street improvement requirements
as administered by the City Engineer.
f) Final development plans shall require the review and
and approval of the Development Preview Commission.

2. The Planning Co~ission hereby grants a Use Permit,
as applied for, to allow the construction and use of a veterinary
medical hospital subject to the following conditions:
a) The recording of Parcel Map No. 71-46, and com-
pliance with the conditions imposed on Parcel 2
of that map, set forth therein by the Planning
Co~ission.
b) Compliance with those odor and noise safeguard
requirements as specified for Small Animal Hospitals
or Clinics in the Zoning Ordinance, Ordinance No.
157, as amended by Ordinance No. 352.
PASSED Am ADOPTED at a regular meeting of the Planning
Co~ission, held on the 26th day of July, 1971.
