V-71-280 OF THE METZ COMPANY ON BEHALF OF THE ARBORETUM, INC. The Planning Commission of the City of Tustin does here- by resolve as follows: 1. The Planning Commission finds and determines: a) That a proper application for variance (No. V-71-280) was filed on behalf of The Arboretum, Inc., for a variance to permit a freeway oriented freestanding sign, 60 feet in height and approxi- mately 577 sq. ft. in total display area, on the the property described as being a portion of Lot 65, Block 10 of Irvine's Subdivision of the City of Tustin. b) That a public hearing was duly cal%ed, noticed and held on said application. c) That because of special circumstances applicable to the subject property,relative to size, shape, topography, location or surroundings, a strict application of the Zoning Ordinance is found to deprive the subject property of privileges en- joyed by other properties in the vicinity and under identical zone classifications, evidenced by the following findings: 1) That the property in question because of ~its appreciably lower grade level and adjacency to a freeway overpass, has an effectively limited line of sight problem relative to both north and southbound traffic on the Newport Freeway. 2) That this commercial use was granted by Use. Permit (UP-70-348) on this industrially zoned Property, which zoning is more restrictive than commercial zoning relative to height and size of signing. d) That the granting of a variance as herein pro- vided will not constitute a grant of special ' privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is situated. e) That the granting of the variance as herein pro- vided will not be contrary to the intent of the Zoning Ordinance or the public safety, health welfare, and said variance should be granted-. 4 § ? 8 9 10 16 18 Z0 £5 ~? ~9 f) Proposed ~development shall be in accordance with the development policies adopted by the city'Council, Uniform Building Codes as administered by the Building Official, Fire Code as administered by the Fire Chief, and requirements as administered by the City Engineer g) Final development plans shall require the review and approval of the Development Preview Com- mission. 2. The Planning Commission hereby grants a variance as applied for, to permit a freeway oriented, freestanding sign 60 feet in height and 400 sq. ft. in total display surface, subject to the following conditions: a) That the .existing lettering (two sides) on the pylon structure be removed. b) That the ~approved freestanding sign be non- rotating or revolving. c) That all other signing on subject site be in conformance with the provisions of the Sign Ordinance.
