UP-71-361 OF TIC TOC MARKETS, INC. The Planning Commission of the City of Tustin does hereby resolve as follows: 1. The Planning Commission finds and determines as follows: a) That a proper application (No. UP-71-361) was filed on behalf of Tic Toc Markets, Inc. for a Use Permit to allow a take-out restaurant and delicatessen on the property fronting approxi- mately 250 feet on the east side of Pasadena Avenue and located approximately 190 feet south of the center line of McFadden Avenue, further known as 15832 Pasadena Avenue, Tustin, California. b) That a public hearing was duly called, noticed and held on said application. c) That establishment, maintenance and operation of the use apPlied for will not, under the circum- stances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced by the following findings: 1) That a similar use exists in the immediate area, which has not been detrimental to the surroundings; 2) That no cooking of food products is proposed-' such goods being contracted for through a catering service; and, 3) That adequate parking for the proposed and existing uses is located on site. d) That the establishment, maintenance and operation of the use applied for will not be injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. e) Proposed development shall be in accordance with the development policies adopted by the City Council, Uniform Building Codes as administered by the Building Official, Fire Codes as adminis- tered by the Fire Chief, and street improvement requirements as administered by the City Engineer. f) Final development plans shall require the review and approval of the Development Preview Commission. 1 2 3 4 § 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 3O 31 333 2. The Planning Con~ission hereby grants:a Conditional Use Permit, as applied for, to allow a take-out restaurant and ~elicatessen, subject to the following conditions: a) That food products involved in this operation will be cooked and prepared off-site, with heating and cooling only being involved on the premises. b) That a landscape screen with irrigation shall be provided adjacent to the sidewalk between the two accessways to effectively screen parked automobiles from public view. c) That all outdoor uses on this shopping center~ site, other than neQspaper racks, be located totally within the business structure. d) °Compliance with the stipulated requirements of the Engineering, Building and Fire Departments as contained in Exhibits "A" "B" and "C" referenced hereby and made a part hereof of this Resolution.
