A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
APPROVING FINAL PARCEL MAP 2001-147 TO COMBINE TWO
EXISTING PARCELS TO CREATE A 4.7 ACRE PARCEL LOCATED AT
13270 NEWPORT AVENUE FOR THE PURPOSE OF DEVELOPING A
RETAIL MARKET WITH DRIVE-THROUGH PHARMACY AND SITE
AMENITIES.
The City Council of the citYof Tustin does hereby resolve as follows:
I. The City Council finds and determines as follows:

That Final Parcel Map 2001-147 is a request to combine two existing
parcels to create a 4.7 acre parcel located at 13270 Newport Avenue for
the purpose of developing a 50,275 square foot retail market and drive-
through pharmacy submitted by Albertsons Inc. for consideration;

That on December 10, 2001, the Planning Commission approved Design
Review 01-018 and Conditional Use Permit 01-014 for development of a
50,275 square retail market with drive-through pharmacy and site
amenities and recommended that the City Council approve Tentative
Parcel Map 2001-147;

That the City Council approved Tentative Parcel Map 2001-147 on
January 7, 2002;

That the Final Parcel Map is in substantial compliance with the Tentative
Parcel Map 2001-14.

That the City Council considered the Final Parcel Map on August 19,
2002.

That the proposed subdivision involves the combination of less than four
(4) parcels and is Categorically Exempt pursuant to Section 15315
(Class 15) of the California Environmental Quality Act (CEQA);

The proposed subdivision will be in conformance with the Tustin Area
General Plan, Tustin Zoning Code, State Subdivision Map Act, and the
City's Subdivision Code;
H. That the site is physically suitable for the type of development proposed;

That the design of the subdivision or the proposed iml~rovements are not
likely to cause substantial environmental damage or substantially and
avoidably injure fish or wildlife in their habitat; and,

That the design of the subdivision or the types of improvements
proposed are not likely to cause serious public health problems.

The City Council hereby approves Final Parcel Map 2001-147 to combine two
existing parcels to create a 4.7 acre parcel located at 13270 Newport Avenue
for the purpose of developing a 50,275 square foot retail market and drive-
through pharmacy with site amenities, subject to compliance with all applicable
regulations to the satisfaction of the City Engineer prior to recordation.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council, held on the
19th day of August, 2002.
